ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING TITLE 19
OF THE SAN BERNARDINO MUNICIPAL CODE CREATING THE R-1-40 ACRE
AND THE PF PUBLIC FACILITIES ZONES AND ESTABLISHING REGULATIONS
FOR THEIR USE.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO

SECTION 3. Chapter 19.45 of the San Bernardino Municipal
Code is added to read as follows:
"Chapter 19.45
PF PUBLIC FACILITIES DISTRICT
19.45.010 Regulations generally.
The regulations set forth in this chapter shall apply to
the PF Public Facilities District.
19.45.020 Uses Permitted.
No building, structure or land shall be used and no
building or structure shall be erected, structurally altered,
or maintained except for the following purposes:
A. Any use operated by a publ~c agency, such as a city,
county, regional, state or federal agency, school district,
pUblic water district or any similar entity, including parks,
schools, libraries, fire stations, pOlice stations, wells or

other water facilities, flood control facilities and waste
disposal or transfer facilities.

B. Any use operated by a quasi-public agency, such as a
private water company, hospital, or other similar entity,
including recreation facilities, medical facilities, agricul-
tural and citrus exhibition grounds and related commercial
uses, institutions, cemeteries, stadiums and museums.
C. Such other uses as the Planning Commission determines
to be similar.
19.45.030 Conditions to use.
All new uses, or expansions to existing uses in this
district shall be subject to a conditional use permit.
19.45.040 Lot area and dimensions.
There are no minimum lot area requirements. The adequacy
of the parcel area and dimensions shall be determined as part
of the conditional use permit.
19.45.050 Building height.
Maximum height of any structure shall be forty-five feet:
provided that within seventy-five feet of any single-family
residential district, the maximum height shall not exceed one
story or twenty feet unless the Planning Commission or Mayor
and Common Council determine that due to unusual topographical
or other features, such restrictive height is not practical or
necessary.
19.45.060 Building coverage.
Maximum building coverage is ten percent of the lot area.
19.45.070 Yards.
There are no minimum yard requirements.
19.45.080 Fences, hedges and walls.
For fence, hedge and wall requirements, see Chapter 19.62.
19.45.090 Loading.

I wish to commend the staff of the City Planning Department and the Verdemont
Citizens Advisory Committee for their dedicated effort in drafting the Verdemont Area
Plan. They have produced a policy document that will not only assist development
decision making for the Verdemont area but will serve also as a model for similar
plans for other areas of San Bernardino. I want to assure you of our support of the
overall plan and of the objectives it seeks to attain.
At my request, several faculty and staff here at the University reviewed the
proposed Verdemont Area Plan. Let me share with you their opinions and suggestions
about specific elements of the plan so you mi&ht consider appropriate action.
"Scenic HiRhways" and "Community Development and DesiRn" - These elements
of the plan address the visual qualities of development in the Verdemont area. They
are crucial, of course, because they affect the daily lives of residents. They also
give visitors their first impression of the area, and we certainly hope to make that
impression positive. The "Scenic Highways" and "Community Development and
Design" elements of the current plan, however, are not fully developed and will
provide little direction to future decision makers interested in well-planned
development in the area.
One of the great attributes of the Verdemont area is its natural beauty and
attractive vistas. A thoughtful review of the "Scenic Highways" and "Community
Development and Design" elements of the area plan, to include fully elaborated
policies and standards, would assist substantially in preserving and enhancing the
visual qualities of the area as development progresses.
"Noise" and "HousinR" - These important elements of the Verdemont Area
Plan make reference to supporting programs and policies to be found in the City's
General Plan. After reviewing closely the pertinent segments of the General Plan,
however, it appears that they may not satisfy the requirements of California
Government Code Sections 65302, 65583, and 65588. The General Plan was pr~pared
years ago and the portions concerning "Noise" and "Housing" may be out of date.

None of the reviewers of the plan here on campus are 'attorneys, but the
State mandates leave little doubt as to their intent and my colleagues believe
the current General Plan elements could be subject to court challenge. You may
wish to bolster these portions of the Verdemont Area Plan by remedying the
shortcomings of the City's General Plan.
Having presented these suggestions, let me reiterate my support for the
Verdemont Area Plan. I applaud the manner in which the City has addressed the
development issues in the vicinity of the University, and I look forward to a
continued constructive relationship with the City in seeing the area developed
over the coming years.
In closing, let me ask that the Verdemont Area Plan be published in an
attractive format that will promote its being read and appreciated by the greatest
possible number of citizens. A format including colored maps and photographic
examples might increase its readability and ultimate impact. Now that so much
work has been done on the plan, such additions might help assure that it will be
fully utilized.
Thank you so much for the opportunity to present these opinions and
suggestions. I wish you and the City of San Bernardino well in your ongoing
efforts to plan the best development of our community.

California State University San Bernardino is located east of
the plan area at University Parkway and Northpark Boulevard.
The University is active in the community and provides
recreational and open space uses and cultural and educational
programs for residents.
Parks:
The City owns two parksites in the Verdemont area: Al Guhin
Park and Buckboard Park. Al Guhin Park is 23 acres in size
and is located south of the Western Regional Little League
Headquarters on Little League Drive. Six acres of this park
have been turfed, while development of the balance will occur
as funding becomes available.
Buckboard Park is a 15 acre site located south of Kendall
Avenue, west of the Wagonwheel subdivision. This site is
undeveloped but planned as a passive open space park with
limited facilities.
Additional parksites are needed to provide neighborhood open
space and recreational amenities within walking distance.
Therefore, the Plan provides for the develo2ment of parksites
bv requiring all residential construction within the
Verdemont Area Plan boundaries to partici2ate in the park
constru~tion fe~ proqram as per Chapter 15.56 of the Citv
Municipal Code. parksites d~veloped under this proqram will
be a minimum of five acre9-1D size and located as shown on
Fiqure 2. Maintenance of these new parksites is to be done
throuqh the creation of an assessment district. The two
existing parksites, Al Guhin and Buckboard Parks, would not
be included since they would be maintained throuqh the
Citvwide park maintenance proqram.

The Plan provides for a system of equestrian, hikinq and
bicycle trails in the Verdemont area. Since they provide a
method of circulation and access using public rights-of way
or easements similar to streets, they are more appropriately
discussed in the Circulation Element. However, their design,

location, construction and maintenance are issues which
require input from the Parks, Recreation and Community
Services Department. Standards and criteria for development
of the trail system are outlined in Section V of this Plan.

The Parks, Recreation and Community Services Department
provides many recreational programs when there is a need for,
or interest in, them. The need for programs in Verdemont is
low because the population is low and dispersed. This is
expected to change as the area continues to urbanize.
Joint-use agreements between the City Parks, Recreation and
Community Services Department and other agencies, such as the
San Bernardino City Unified School District, have worked
successfully in other areas of the City and are recommended
for Verdemont. School buildings can be used for community
meetings and playgrounds can be used by neighborhood children
when such use does not conflict with normal school
activities.
Glen Helen Regional Park is located west of the Verdemont
area and is accessible from Devore Road. The Park is
approximately 2000 acres in size and contains the Glen Helen
Bowl, a large outdoor amphitheater, a fishing lake, camping
and hiking and equestrian trails. Glen Helen Park is planned
to include facilities such as cycle parks, an international
auto raceway and a rifle/skeet range.

IV. IMPLEMENTATION /.lEASURES
The review and approval process ensures that new developments
will provide the necessary facilities and services. All
proposed projects require comments from City departments or
other agencies that will serve the project. If necessary,
projects will be required to be redesigned to improve the

requires fees or dediation of land for park and recreation
purposes. The City can also require dedication of bicycle
paths in subdivisions of 200 or more parcels. At the time of
Plan adoption, City ordinances are in effect for the
dedication of park land or the collection of fees, but not
for dedication of bicycle paths.

and circulation. These are in addition to all standard
require-ments currently in effect.
The City may impose any such conditions it deems necessary to
protect the best interests of the surrounding neighborhood as
well as to implement the goals, objectives and policies of
the Verdemont Area Plan. All dwellinq units built prior to
the effective date of this Area Plan are exem2t from these

Prominent Knolls: A highly visible hill
or hilltop which provides a point of
orientation or reference for the
observer. It is generally a feature of
significance within an area rather than
one of community-wide importance.
Projects shall incorporate clustering,
variable setbacks, multiple orientations
and other site planning techniques to
avoid the appearance of a solid line of
development.
Building sites shall be located below or
beside prominent knolls and where
possible below the natural crest of
ridgeline.
All buildings shall be hillside adaptive,
i.e., the basic structure shall conform
to the natural topography. Development
shall not be terraced to accommodate
flat-pad construction in areas where the
ridgeline slope exceeds 15%.

Section I. Recitals.
(a) The General Plan for the City of San Bernardino was
adopted by the Mayor and Common Council by Resolution No. 7336
on August 17, 1964.
(b) General Plan Amendment No. 86-3 to the General Plan
of the City of San Bernardino was considered by the Planning
Commission on September 16, 1986, after a legally advertised
public hearing, and the Planning Commission's recommendation
has been considered by the Mayor and Common Council.
(c) An environmental impact report was prepared by the
Environmental Review Committee of the City, for General Plan
Amendment No. 86-3, and all comments relative thereto have been
reviewed by the Planning Commission and the Mayor and Common
Council in compliance with the California Environmental Quality
Act and local regulations.
(d) The Mayor and Common Council fully reviewed and
considered proposed General Plan Amendment No. 86-3 on Nove~er

(el The adoption of General Plan Amendment No. 86-3 is
deemed in the interest of the orderly development of the City
and is consistent with the goals and objectives of the existing
Citywide General Plan.
SECTION 2. Environmental Impact Report. The Mayor and
Common Council hereby find and declare that the proposed
amendment to the General Plan of the City of San Bernardino
will not have a significant effect on the environment, and the
environmental impact report and its addendum heretofore
approved by the Planning Commission is hereby ratified,
affirmed and certified.
SECTION 3. Amendment.
(al The General Plan of the City of San Bernardino is
amended as per the document entitled .Verdemont Area Plan,. a
copy of which is attached hereto and incorporated herein by
reference. This amendment is designated as General Plan
Amendment No. 86-3.
(b) The development standards set forth in this Plan are
mandatory and shall be part of the development review standards
by which applications for development permits are judged.
(c) The Plan shall become effective immediately upon
adoption of this resolution. It shall apply to all development
permits which have not received final approval by the
Development Review Committee, the Planning Commission or the
Mayor and Common Council as appropriate.
