CITl OF SAN BERNARDIt ) - REQUE" T FOR COUNCIL ACT DN
STAFF REPORT
Upon recelvlng a request from 100% of the adjoining owners to vacate a
portion of Harriman Place, East of Hospitality Lane, and after notifica-
tion of all interested Ci ty Department Heads and Uti li ty Companies, your
Honorable Body approved the attached Plan No. 7071 and authorized this
office to proceed on October 20, 1986.
On the same date the Resolution of Intention, which contains the reser-
vation of a Public Utility Easement, was approved. As required by law,
the portion proposed for vacation was posted by this office on October
29, 1986,and the Resolution was pUblished on the same date.
In the opinion of this Division, there is no further necessity for a
portion of Harriman Place, East of Hospitality Lane either for present
or prospective street purposes. Therefore, we recommend the vacation on
the basis of the following Findings of Fact:
1. The above portion of the street has been determined by the Planning
Oepartment and the Public Works Department to be of no further
necessity to the general pUbiic.
a) The proposed vacation is a result of the extension of Harriman
Place to Rosewood Drive, to the East, thus eliminating the
need for the existing cul-de-sac.
b) The Public Works Department has made it a condition of the
vacation that the proposed extension be dedicated, and this
requirement has been fulfilled.
c) The Plan meets the approval of the Planning Department, and is
consistent with the General Plan.
2. 100% of the adjoining owners have requested the proceedings, and
the required $400.00 fee has been paid.
a) By virtue of the posting and pUblication of the proposal,
neither this office nor the City Clerk's office has received
any written protests against the vacation as of this date.
3. All the interested City Department Heads and Utility Companies were
notified of the proposal, and all have given their respective
consent. A reservation for a Public Utility Easement was
requested, however, and same has been provided for in the
Resolution of Intention.
a) The fact that a Public Utility Easement has been reserved,
does not indicate the necessity for general public use of the
area in question,
No special requirements have been placed upon the proponents
relative to the proceedings which would require an inspection of
the area prior to the adoption of the Resolution Ordering.
Therefore, we have attached the said Resolution Ordering the
vacation for your action.
