Recommended motion: 1, That the hearing be closed and the Findings of Fact. as set forth in the Staff Report from Roger G. Hardgrave, Director of Publ ic Works/City Engineer, as to why a portion of Harriman, East of Hospitality Lane, is no longer necessary for street purposes, be adopted. and 2. Council Notes: 1 Agenda It~-:~,d 9, - 75-0262 CITl OF SAN BERNARDIt ) - REQUE" T FOR COUNCIL ACT DN STAFF REPORT Upon recelvlng a request from 100% of the adjoining owners to vacate a portion of Harriman Place, East of Hospitality Lane, and after notifica- tion of all interested Ci ty Department Heads and Uti li ty Companies, your Honorable Body approved the attached Plan No. 7071 and authorized this office to proceed on October 20, 1986. On the same date the Resolution of Intention, which contains the reser- vation of a Public Utility Easement, was approved. As required by law, the portion proposed for vacation was posted by this office on October 29, 1986,and the Resolution was pUblished on the same date. In the opinion of this Division, there is no further necessity for a portion of Harriman Place, East of Hospitality Lane either for present or prospective street purposes. Therefore, we recommend the vacation on the basis of the following Findings of Fact: 1. The above portion of the street has been determined by the Planning Oepartment and the Public Works Department to be of no further necessity to the general pUbiic. a) The proposed vacation is a result of the extension of Harriman Place to Rosewood Drive, to the East, thus eliminating the need for the existing cul-de-sac. b) The Public Works Department has made it a condition of the vacation that the proposed extension be dedicated, and this requirement has been fulfilled. c) The Plan meets the approval of the Planning Department, and is consistent with the General Plan. 2. 100% of the adjoining owners have requested the proceedings, and the required $400.00 fee has been paid. a) By virtue of the posting and pUblication of the proposal, neither this office nor the City Clerk's office has received any written protests against the vacation as of this date. 3. All the interested City Department Heads and Utility Companies were notified of the proposal, and all have given their respective consent. A reservation for a Public Utility Easement was requested, however, and same has been provided for in the Resolution of Intention. a) The fact that a Public Utility Easement has been reserved, does not indicate the necessity for general public use of the area in question, No special requirements have been placed upon the proponents relative to the proceedings which would require an inspection of the area prior to the adoption of the Resolution Ordering. A RESOLUTION OF THE CITY Of SAN 8ERNARDINO VACATING A PORTION OF HARRIMAN PLACE, EAST'OF HOSPITALITY LANE, IN THE CITY OF SAN BERNARDINO AND RESERV ING PUBL IC UTIL ITY EASEMENTS THEREIN. BE IT RESOLVED BY THE MAYOR AND COMMON COUNC IL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1: The Mayor and Common Council of the City of 7 San Bernardino, having heard the evidence offered in relation to the proposed vacation of a portion of Harriman Place, east of Hospitality Lane, more particularly described in City Resolution of Intention No. 86-430, hereby find from all of the evidence submi tted that such street proposed to be vacated by said Resolution are unnecessary for present or prospective street purposes. SECTION 2. The Mayor and Common Council of said City do 15 hereby vacate a portion of Harriman Place, East of Hospitality 16 Lane, more particularly described as follows: Those portions of Harriman Place as shown on Tract No. 12034 per map recorded in Book 168 of Maps, pages 75-87, incl usive, Records of San Bernardino County, more particularly described as follows: 17 18 19 20 21 22 23 24 PARCEL A: COMMENCING at the Easterly common lot corner of Lot 24 and Lot 25 of said Tract: THENCE North B9048'35" West along the common lot line of said lots a distance of 447.74 feet to a point on a non-tangent curve, concave Westerly, havi ng a radi us of 60.00 feet, through whi ch a radial line bears North B9048'35" West, said point al so being the Westerly common lot corner of said lots; 25 26 I 27 II II 28 1 1 2 3 4 THENCE, Northerly on said curve to the left, through a central angle of 38004'23", for an arc distance of 39.87 feet, to a point through which a radial line bears North 52007'01" East, said point is 37.00 feet at right angles, from the Easterly prOlongation of the centerline of Harriman Place and is also the TRUE POINT OF 8EGINNING. 5 7 THENCE, North 89048'35" West, parallel to the centerl i ne of Harri man Pl ace, a di stance of 129.88 feet to a point of cusp with a curve, concave Northwesterly, having a radius of 100.00 feet, through which a radial line bears South 000U'25" West. 6 8 9 10 11 12 13 14 15 16 THENCE, Northeasterly on said curve to the left, through a central angle of 31006'07", for an arc distance of 54.28 feet to a point of reverse curve, concave Southerly, having a radius of 60.00 feet; THENCE, along said curve to the right, through a central angle of 83001'44", for an arc distance of 86.75 feet, to the TRUE POINT OF BEGINNING. Nothing in this Resolution shall in any way 8 affect or disturb any existing easements for Public Utility 9 purposes belonging either to the City of San Bernardino as to 10 any Public Utility and is hereby reserved for future general 11 Public Utility Facilities in, over, under and across a portion 12 of the real property herein above described, and to vie, 13 maintain, replace or renew such facilities and those reserved 14 15 16 17 18 19 20 21. 221 by Resolution of Intention No. 86-430. SECTION 4. The City Clerk of the City of San Bernardino shall cause a certified copy of this Resolution to be recorded in the office of the County Recorder of the County of San Bernardino.
