The primary concern is the number of registered voters being used to
arrive at the required percentages. The figure we have been working
with is 6,140. This is the sum of the precinct totals which were
effective in January, 1986. The list of registered voters in the

annexation area was later revised to a total of ~~. That list is
dated March 10, 1986.
There was also concern expressed about City Employees who live in
the annexation area and were reluctant to sign potests.
Also that the protests were not being processed by a "neutral"
party, but by the City itself.
There was also a report of a rumor that the City does not want an
election.

HEARING DATE: February 19, 1986
RESOLUTION NO. 2027
A RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION OF THE
COUNTY OF SAN BERNARDINO MAKING DETERMINATION ON LAFC 2365
and approving the Reorganization to include Multiple Annexations to the City of
San Bernardino (area generally nine separate islands of unincorporated territory
located north of Highland Avenue. between Waterman and Boulder Avenues).
On motion of Commissioner Riordan . duly seconded by Commissioner
Dondelinger . and earned. the Local Agency Formation Commission
adopts the fOllowing resolution:
WHEREAS, an application for the proposed reorganization in the County of San
Bernardino was heretofore filed with the Executive Officer of this Local Agency
Formation Commission in accordance with the Cortese/Knox Local Government
Reorganization Act of 1985 (Govt. Code Section 56000 et. seq.), and said Executive
Officer has examined said application and executed his certificate in accordance
with law, determining, and certifying that said filings are sufficient; and,
WHEREAS, at the times and in the form and manner provided by law, said
Executive Officer has given notice of public hearing by this Commission upon said
application; and,
WHEREAS, said Executive Officer has reviewed avallable information and
prepared a report including his recommendations thereon, said filings and report
and related information having been presented to and considered by this Commission;
and,
WHEREAS, the public hearing by this Commission was held upon the date and
at the time and place specified in said notice of public hearing and in order or orders
continuing such hearing; and,
WHEREAS, at such hearing, this Commission heard and received all oral and
written protests; the Commission considered all plans and proposed changes of
organization and reorganization, objections and evidence which were made,
presented, or filed; it received evidence as to whether the territory is inhabited
or uninhabited, improved or unimproved; and all persons present were given an
opportunity to hear and be heard in respect to any matter relating to said application,
In evidence presented at the hearing;
NOW, THEREFORE, BE IT RESOLVED, that the Local Agency Formatlon
Commission of the County of San Bernardino does hereby determine, resolve, order,
and find as follows:
DETERMINATIONS:
SECTION I. The Executive Offlcer Is hereby authorized and directed to mall
certified copies of this resolution In the manner provided by Section 56853 of the
Government Code.
SECTION 2. The proposal is approved subject to the terms and conditions hereinafter
specified:
CONDITIONS:
Condition No. I. The conducting author1ty for this proceeding shall be the
City Councll of the City of San Bernardino.
Condition No.2. The boundarles are approved as set forth In Exhlbit . A'
attached.

CondItion No.3. The following distinctive short form designation shall be
used throughout this proceeding: LAFC 2365.
Condition No.4. The date of Issuance of the Certificate of Completion shall
be the effective date of this reorganization.
SECTION 3. The conducting authority Is hereby directed to Initiate appropriate
proceedings in compliance with this resolution and State law.
SECTION 4. The conducting authority shall not make any changes In the boundaries
-hereby approved nor shall it impose any new conditions or modify any conditions
hereby imposed unless and until it receives the approval of the Local Agency
Form"ation Commission for such changes, modifications, or conditions, purusant
to the procedures prescribed in Section 56857 of the Government Code.
SECTION S. Upon completion of its proceedings, the conducting authority Is directed
to adopted Its own resolution setting forth its action relating to the proposal
considered and forward the required number of certified copies of the resolution
to the Local Agency Formation Commission.
SECTION 6. Upon receipt of the resolution of the conducting authority approving
said action the Certificate of Completion shall be prepared and filed.
SECTION 7. Approval by the Local Agency Formation CommissIon Indicates approval
of this proposal by the conducting authority would accomplish the proposed change
of organization in a reasonable manner with a maximum chance of success and
a minimum disruption of service to the functions of other local agencies in the
area.
SECTION 8. The followIng findings are made relevant to Section 56375 of the
Government Code:
1. The areas tn question are all totally or substantially surrounded by the boundaries
of the City of San Bernardino.
2. The areas in Question are all within the City of San Bernardino sphere of
influence and are designated for urban land uses.
3. None of the areas in question contain prime agricultural land as defined in
Section 56064 of the Government Code.
4. All of the areas in Question are substantially developed or developing.
The following findings are noted in conformance with Commission polley:
5~ _The subjectl,2BO (approxImate) acre areas are legally Inhabited.
6. The County Assessor has determined the valuation of the entire area to be
$170,472,501 (land, improvements, and utilities). The City and County have
negotiated the transfer of ad valorem taxes as required by this proposal and
copies of the resolutions adopted by the City Council of the City of San
Bernardino and the San Bernardino County Board of Supervisors are on file
in the office of the Local Agency Formation Commission. The staff notes
that the property tax rates will essentially remain the same with the only
identifiable increase in taxes to residents being the City's ut1l1ty users tax
(an 8% tax on gas, electric, phone, and cable tv bills).
7. A Negative Declaration has been prepared pursuant to the provisions of the
CaUfornla Environmental Quality Act (CEQA) indicating the reorganization
wjll have a non-significant effect on the environment. LAFGO adopted the
Negal1ve Declaral10n and a copy is on file In the Office of the Clerk. The
Clerk has been instructed to file the Notice of Determination within five days.

8. This proposal Is consistent with adopted City and County General Plans for
the area.
9. Local agencies presently serving the areas are listed in the file. All County
Service Areas and their improvement zones are automatically detached from
the areas upon city annexation. None of the other agencies are affected by
this proposal.
10. The City of San Bernardino has submitted a Plan for Municipal Services as
required by law. The Plan Indicates that the City of San Bernardino can provide
the full range of its services to the islands immediately upon annexation, and
that the level of those services either meets or exceeds service levels now
provided by the Cbun ty.
11. The areas in question can benefit from the availability of services from the
City of San Bernardino.
12. This proposal and 1ts antlcipated effects conform with adopted Commission
policies.
13. All notices required by law have been provided. Protest has been received
and considered by the Commission in making Its determination.
14. Maps and legal descriptions meet state standards.

Proposed Annexation
Highland Islands
NOTICE IS HEREBY GIVEN that the Mayor and Common
Council of the City of San Bernardino will hold a pUblic hear-
ing to consider the proposed annexation of nine islands of
Inhabited and uninhabited territory located generally North of
Highland Avenue, between Waterman Avenue and Boulder
Ave.
Proceedings for the referenced proposal were initiated by the
City of San Bernardino and submitted to the County of San
Bernardino local Agency Formation Commission. The short-
form designation of the proposal is lAFC 2365.
The City Clerk has fixed Thursday, March 13, 1986, at the
hour of 9:00 a.m. in the Council Chambers of City Hall, 300
North "0" Street, San Bernardino, CA. 92418, as the date,
time and place for a pUblic hearing on the proposal, at which
time and place the Mayor and Common Council will hear and
receive any testimony, objections or evidence which is made,
presented or filed. .
Any registered voter residing within the territory or any owner
of land within the territory who wishes to file written protest
against this annexation, must do so by written communication
filed with the City Clerk, P,O. Box 1318, San Bernardino, Ca.
92402, which must be filed not later than the hour specified in
this notice for commencement of the hearinQ. Each written
protest must state whether it is made by a landowner or
registed voter and must indicate the name and address of the
owner of land affected and the street address or other de-
scription sufficient to identify the location of the land, or the
name and address of the registered voter as it appears on the
affidavit of registration.
