The natural slope of this parcel is to the southeast. The Developer inquired if storm water from this site could be discharged into the ditch southerly of hi s property. We explained that this ditch is on Southern Pacific property, and their permission would be required to discharge water from this development. They have evidently been unable to secure permission. Southern Pacific's refusal is based partly on the fact that the block retaining wall along the .south side of the existing Mobilehome Park, on the southwest corner of Meridian Avenue and Second Street, suffered damage, from storm waters in rains of recent years. The owner of this Mobilehome Park (Wales) filed suit against the City and Southern Pacific. This suit contended that the pipe under the railroad at Pepper Avenue was inadequate, which resulted in storm waters being diverted to flow easterly in the ditch. A judgement has been rendered by the court that the City and Railroad are equally at fault. This judgement is now under appeal. The only feasible method to drain the site of the proposed development is to direct the storm waters to Pepper Avenue. This will of course introduce additonal storm waters to Pepper Avenue. After several discussions with the Developer, an agreement has been. reached that he will install a reinforced concrete box culvert under the rail- road with adequate hydraulic capacity to handle current and projected flows in Pepper Avenue. Installation of this culvert will avoid any future occurrences of damage to the wall of the Mobilehome Park, and resulting legal action. The preliminary estimate of cost for this box culvert is $100,000. There is the potential of flooding problems being created south of the railroad, due to the additional capacity for conveying storm water. Our Storm Drain Master Plan shows a 48-inch pipe in Pepper Avenue, from Rialto Avenue southerly to the East Rialto Channel (along the north side of the Santa Fe Railroad). An alternate, to installation of the box culvert, is the construction of the Master planned storm drain, extended northerly under the Southern Pacific Railroad. The preliminary estimate of cost, for installation of the storm drain, from the East Rialto Channel to north of the Southern -Pacific Railroad, is $160,000. The Developer has indicated a willingness to contribute $100,000 to construction of the storm drain, in lieu of .the-box culvert. Several advantages are apparent in the evaluation of the storm drain alternate. In view of the considerable participation by the Developer, we recommend the storm drain alternate be approved. This selection would require the allocation of $60,000 in the 1986-87 Storm drain Construction Fund Budget to provide funds for the City's share. It is possible that Southern Pacific could be convinced to participate, since the court judgement requires the City and Railroad to take action to prevent any future damage to the Mobilehome Park.
