Synopsis of Previous Council action:
Weed abatement charges of $1000.38 appealed before Board of Building Commissioners
on February 7,1986. Board denied protest and approved additional charges of $55.00
for processing fees.
On March 3, 1986, Mayor and Common Council set March 17, 1986, at 9:00 am in the
Council Chamber of City Hall to hear the appeal filed by Donald Cannan.

STAFF REPORT
On or about April 1, 1985, an inspection was made of parcel # 0136-441-07, located on South
\~ashin9ton St., in the City of San Bernardino. It was found that the property, a vacant lot,
contained \~eeds, debris, used lumber, trash, etc. This inspection \~as made as a part of a
routine survey. A "Notice to Clean Premises" was sent to the owner of record on April 1,1985.
Tha t Notice stated that a 11 weeds and debri s mus t be complete ly removed withi n ten days from
the date of the Noti ce. .
On June 25, 1985, Mr. Ed ~larti n , ~Iho was hi red by the Ci ty to do weed abatement, di sced the
rear portion of the lot, since this area contained only weeds. Mr. Martin did not contract
with the City to do any handcleaning or debris removal, so the remainder of the cleanup was
scheduled to be done by City crews. Since City crews are engaged in other duties, including
the cleaning of other lots, the the remainder of the work was not able to be done until October
11, 1985. The total cleanup costs amounted to $1000.38. An invoice stating the charges was then
prepared and sent to the owner of record, Mr. Donald Cannan.
On January 2, 1986, a letter of protest was filed by Mr. Cannan, and the matter set up to be
heard by the Board of Building Commisioners on February 7,1986. The Board, having then heard
the facts, denied Mr. Cannan's protest and upheld the charges, allowing an additional $55.00
to be added for processing fees.
Mr. Cannan's bas i s for appea 1 seems to be the actual amount of debri s removed from the property.
The debris removed \>Ias loaded mechanically with the use of a skip loader into trucks having a
capicity of 5 cubic yards or 8 tons. Depending upon the actual wieght of the materials, the
actual load may be less then 5 cubic yards. The weight ticket reciepts show a total of 204,250
pounds having been taken"to the dwnp. Assuming that each load was the maximum of 5 cubic yards
(which was not the actual case, since some of the materials removed included broken concrete and
asphalt, which yields less then 5 cubic yards if loaded to the maximum capacity of 8 tons), this
would only amount to 3,375 cubic f~et and not 27,000 as Mr. Cannan stated in his letter. This
certainly is not an unbelievable fj~~rc.
I recoITmend that the Mayor and Common Council uphold the decision made by the Board of Building
Commissionel's, and allow all charges to remain as stated. The basis for this recommendation is
that all procedures were carried out properly as set forth by San Bernardino Municipal Code
8.27. More than ample time was given to Mr. Cannan to abate the property himself, and Mr. CannaL
never made any contact with this office, even though Notice was given, until a bill was sent.

Dear Mr. Cannan,
Pursuant to our conversation of 12/11/85, I reviewed the matter
pertaining to the cleaning of your parcel, APN #136-441-n7, located on
South Washington.
On April 1, 1985, you were notified to clean your parcel of all
weeds, debris, etc. That notice also gave you the right to protest
the proposed abatement within ten days of the date of the notice. Since
you did not protest the matter, abatement was scheduled, The rear
of the lot was disced on June 25, 1985. The front portion of the lot
had numerous piles of debris, old furniture, trash, etc, Since the
City does not contract out debris removal this had to be scheduled
with city forces. 'fhere is only one crew that does this type of work,
and thus we were not able to complete the abatement untill October 11,
.1985. This is due to the numerous other duties the city must perform,
include debris removal of other lots. This is an ongoing process.
You were billed for the work performed, and you contacted me
to notify me that you were disatisfied with the charges. The
notice did state that, at your option, you may abate your parcel
yourself, or if you did not do the abatement, the city would accomplish
the abatement and charge you accordingly.
Since you had ample notification of the proposed abatement, and
several months lapsed before the city did the abatement, I feel the
charges are fully justified and will remain as stated. The question of
illegal dumping is not the issue. We had no knowledge of where the
debris came from, but as the owner of the property, you have the re-
sponsibility of maintaining it, which includes the removal of all hazards
and or nuisances. .
If you still wish to protest this matter, you may do so by
submitting your written protest to the city clerks office, 300 N.
"D" St., San Bernardino, CA 9241.8. A hearing date will be set up
before the Board of BuDding Commissioners nnd you will receive
notification of the date. They will hear the facts and decide this
matter. Your written protest must be filed no Inter then January
1.7, 1.986.

Dear ~~yor Wilcox,: Madam, end Sirs:
I wish to appeal the split decision rendered by the Building
Commission on Friday, February 7, 1986. This decision upheld
the outrageous bill, in excess of $1,000,00, for clean-up of
lot #136-441-07 located on South Washington Street,
I have been paying to the City, since its annexation of this
area, and prior to this, to the county, for lot clean-up of
this property as well as several others in the area. Last year,
I paid $80.00 for discing this same lot and this year I receive
a bill in excess of $1,000.00 for clean-up of same,
Mr. Les Fogassey of the Street Department claims building debris
was found there. I assure you I had no part in putting it there.
The numbers he presented to the board stretch my 'believability'.
I was billed for a total of 204,250 1bs. According to Mr, Fogassey,
in excess of 100 cubic yards were hauled away - 25 truck loads of
4 yards each. This amo~nts to 27,000 cubic feet which would fill
a space of 50 X 100 X 5 feet. Nowhere can I see such amounts
pictured on the photos presented at the meeting.
In checking over the solid weight receipts of 10-10-86, I find it
hard to believe that four people - 3 of whom I presume are the
drivers of International truck'#435, Ford truck #420 and Ford
truck #422 - could load and transport to the dump, site #8, 19
loads carrying a total of 141,230 1bs.
This is billed as "additional handcleaning", referring to invoice
#W12966, copy of which is enclosed. It definitely took much better
hands than I can conceive to handle and load 19 trucks with all that
debris in one day. The other six loads weighing 63,020 lbs were

loaded and delivered to dump on the next day, 10-11-86. The
breakdown of refuse class was as follows:
9 loads residential debris
5 loads commercial type debris
7 loads land clearing type, trees,
3 loads demolition type
1 load solid fill
Refuse class 1
Refuse class 2
bushes, etc. Refuse class 4
Refuse class 8
Refuse class 8
The excesses, both in the figures and in the fee forces me to
appeal to you, Mayor Wilcox and to the Common Council, for a
reconsideration.
