Recommended motion: 1. That the hearing be closed and the Findings of Fact, as set forth in the Staff Report from Roger G. Hardgrave, Di rector of Publ ic Works/City Engineer, as to why a portion of Hospitality Lane, West of Carnegie Drive is no longer necessary for street purposes, be adopted. and 2. OF SAN BERNARDIl .l - REQUE J FOR COUNCIL ACt DN STAFF REPORT Upon recelvlng a request from 100% of the adjoining owners to vacate a portion of Hospitality Lane, West of Carnegie Drive, and after notification of all interested City Department Heads and Utility Companies, your Honorable Body approved the attached Plan No. 6B79 and authorized this office to proceed on February 17, 19B6. On the same date, the Resolution of Intention, which contains a reservation for public utility easements, was approved. As required by law, the portion proposed for vacation was posted by this office on February 24, 19B6, and the Resolution was published on the same date. In the opinion of this Division, there is no further necessity for a portion of Hospitality Lane, West of Carnegie Drive, either for present or prospective street purposes. Therefore, we recommend the vacation on the basis of the following Findings of Fact: 1. The above portion of the street has been determined by the Planning Department and the Department of Publ i c Works to be of no further necessi ty to the general publ i c. a) The area to be vacated constitutes the "wings" of a cul-de-sac which was temporary in nature and are no longer needed as such as Hospitality Lane is now being constructed through to Wa terman Avenue. b) The Master Plan provided for the extension of Hospitality Lane to Waterman Avenue which negated the need for the cul-de-sac, therefore, this proceeding will not interfere with the Master Plan. 2. 10D% of the adjoining property owners have requested the proceedings and the required $400.00 fee has been paid. a) By virtue of the posting and publication of the proposal, neither this office, nor the City Clerk's Office, has received any written pr'otests against the vacation as of this date. 3. All of the interested City Department heads and Utility Companies were notified of the proposal and all have given their respective consent. A reservation of an easement for public utilities was requested, however, and same has been provided for in the Resolution of Intention. a) The fact that a utility easemnt has been reserved in the area to be vacated does not indicate the necessi ty for general public use of the area in question. No special requirements have been placed upon the proponents relative to the proceedings which would require an inspection of the area prior to the adoption of the Resolution Ordering. A RESOLUTION OF T~E CITY OF SAN BERNARDINO VACATING A PORTION OF HOSPITALITY LANE, WEST OF CARNEGIE DRIVE IN THE CITY OF SAN BERNARDINO; AND RESERVING PUBLIC UTILITY EASEMENTS THEREIN. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1: The Mayor and Common Council of the City of San Bernardino, having heard the evidence offered in relation to the proposed vacation of a portion of Hospitality Lane, West of Carnegie Drive, more particularly described in City Resolution of Intention No. 86-49, hereby find from all of the evidence submitted that such street, proposed to be vacated by said Resolution, is unnecessary for present or prospective street purposes. SECTION 2. The Mayor and Common Council of said City do hereby vacate a portion of Hospitality Lane, West of Carnegie Drive, San Bernardino, California, more particularly described as follows: Those portions of Hospitality Lane as shown on Tract No. 12034 per map recorded i~ Book 168 of ~laps, pages 75-87 inclusive, Records of the County Recorder of San Bernardino County, State of California, more particularly described as follows: PARCEL A COMMENCING at a point on the centerline of Hospitality Lane that is North 720 19' 16" East 248.08 feet from the North- easterly right-of-way of the San Timoteo Creek as shown on said Tract No. 12034. Said point is also the beginning of a 1200 foot radius curve concave Southerly with a central angle of 030 17' 20". PARCEL B COMMENCING at a point on the centerline of Hospitality Lane that is North 720 19' 16" East 248.08 feet from the Northeasterly right-of-way of the San Timoteo Creek as shown on said Parcel Map 8493. Said point is also the beginning of a 1200 foot radius curve concave Southerly with a central angle of 030 17' 20". A radial line at said point bears North 170 40' 44" We s t. This Resolution shall reserve, and nothing herein shall in any way affect or disturb each and every existing easement for sanitary sewer and appurtenant facilities and for public utility purposes belonging either to the City of San Bernardino or to any public utility and there is further reserved for present and future general publ ic uti 1 i ty purposes and for this City an easement reasonably necessary to locate . sanitary sewer, public utility and appurtenant facilities over, in, under or across the real property described hereinbefore along with the right to use, install, maintain, repair, replace or renew such facilities and those reserved by Resolution of Intention No. 86-49.
