STAFF REPORT
A request was received to vacate an East/West alley located
East of Gardena Street and North of Sth Street, from the owners
who adjoin the portion to be vacated relative to the proposed
construction. This request represents 66% of those owners who
adjoin the alley.
All of the interested City Department Heads and the Utility
Compani es were noti fi ed of the proposal on November 5, 1985,
wi th a reply due on December 2, 1986. The util i ty companies
have responded and no reservation for a public utility easement
was requested.
The Planning Department has responded and indicates that "...
the proposed vacation...was recommended for approval."
The proponents have been notified by letter on December 9,
1985, and have responded with notification for us to proceed.
The required $400.00 fee has been paid and it is, therefore,
recommended that favorable consideration be given to the
requested vacation.
The Resolution of Intention, which sets a protest date of April
7, 1986, has been attached hereto for your action also.

A RESOLUTION OF THE CITY OF
ITS INTENTION TO ORDER THE VACATION
ALLEY LOCATED EAST OF GARDENA STREET
SAN BERNARDINO DECLARING
OF THAT CERTAIN EAST/WEST
AND NORTH OF FIFTH STREET.
BE IT RESOLVED BY THE MAYOR AND COMt~ON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the
City of San Bernardino hereby declares its intention to order
the vacation of that certain East/West alley located East of
Gardena Street.and North of Fifth Street. in said City. which
said portion is more particularly described as follows:
The North 20.00 feet of Lot 12. Block B, Tract
No. 1942. as per plat thereof recorded in Book
28 of Maps. page 10, records of the County
Recorder of San Bernardino County. State of
California. -
SECTION 2. That the Mayor and Common Council of the
City of San Bernardino, in vacating the above described portion
of said alley, elects to proceed under and in accordance with
the provisions of the "Public Streets. Highways and Services
Vacation Law", being Division 9, Part 3. of the Streets and
Highways Code of the State of California.
SECTION 3. That the hour of 9:00 A.M. on the 7th day
of April. 1986. in the Council Chamber of the City Hall, San
Bernardino. California, be, and the same hereby is fixed as the
time and place when and where all persons interested in or
objecting to the proposed vacation may appear before the said
Mayor and Common Council and offer evidence in relation
thereto. For further particulars as to the pr'oposed vacation
of the hereinbefore described portion of said alley. reference

is made to that ce~ain map mark! "Plan No. 6859" approv!
March 3, 1986, on fi le in the office of the Ci ty Clerk of said
Ci ty.
SECTION 4. That the City Engineer of the City of San
Bernardino hereby is directed to cause Notices of Street
Vacation to be posted as required by the Public Streets,
Highways and Services Vacation Law.
SECTION 5. That the City Clerk shall certify to the
adoption of this Resolution of Intention and shall cause the
same to be pUblished once a week for two successive weeks in
The Sun, a newspaper published and circulated in the City of
San Bernardino, prior to the date of the above public hearing.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a _meeting thereof held on the
day of 1986, by the following vote,
