Monday, February 10, 1986, adoption of the resolution relating to tax negotiations for LAFC NO. 2365, entitled, "Property Tax Transfer to the City of San Bernardino, LAFC. No. 236.5". Attached is a copy of our recommendation, the resolution to be adopted, arid the breakdown of transfers to be made, as submitted to the Board of Supervisors. When it is approved, the Local Agency Formation Commission Office will send you a copy showing the action taken by the Board. ". Senate Bill 180 requires that your City Council also adopt a resolution relating to the tax transfer and forward that to the Local Agency Formathm Commission Office. RIGNEY CoWlty Admlnlstrative Officer PROPERTY TAX TRANSFER TO THE CITY OF SAN BERNARDINO, LAFC NO. 236' RECOMMENDATION: Adopt a resolution transferring $351,362 to the City of San Bernardino as a result of pending annexation. BACKGROUND: State law requires that agreement on distribution of property tax relating to proposed boundary changes be reached before the Local Agency Formation Commission issues a Certifcate of Filing. On May 19, 1980, the Board approved the formula for property tax transfers which had been agreed upon by county staff and a committee of city managers. The subject tax transfer includes the amount derived by formula plus an additional amount recognizing that this annexation consists of developed areas with significant population and that the annexation provides for more efficient delivery of municipal services. '- This action will determine the share of property tax revenue to be allocated as a result of this jurisdictional change and shall only be effective upon satisfactory completion of annexation proceedings. ". BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. The Mayor and COllmon Council of the City of San Bernardino hereby find and determine that: A; Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a certificate of filing by the '. Local Agency Formation Executive Officer, the governing bodies of all local agencies whose service area or service responsi- bilities will be altered by a proposed jurisdictional change -- , ' will negotiate and determine by resolution the amount of property tax revenues to be exchanged between and among such local 'agencies.
