2 RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION
NO. 84-530 ENTITLED IN PART "RESOLUTION . . . ESTABLISHING
3 GUIDELINES FOR TRANSFER OF SEWER CAPACITY RIGHTS. . ." TO
REQUIRE THE PURCHASER OF SEWER CAPACITY RIGHTS FOR A RESIDENTIAL
4 HOUSING DEVELOPMENT TO EXECUTE A COVENANT TO RUN WITH THE LAND
WAIVING THE RIGHT TO A DENSITY BONUS.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. Resolution No. 84-530 Section 1 is amended by
X adding thereto Subsection 12 to read as follows:
9 "12. Each purchaser of sewer capacity rights for a
10 residential housing development shall be required to execute a
11 covenant to run with the land waiving the right to a density
12 bonus for the subject development as provided in City of San
13 Bernardino Resolution No. 86-
"
