STAFF REPORT
The City of San Bernardino has requested the County of San Bernardino to par-
ticipate in the cost of resurfacing Del Rosa Avenue from Eureka Street to 39th
Street. Approximately 77% of this section is within the corporate limits of
the City of San Bernardino. City portions are the west side of Del Rosa Avenue
from Eureka Street to Foothill Drive and both sides from Foothill Drive to 39th
Street.
The proposed agreement provides, in general, that the City will act as lead a-
gency and the resurfacing will be performed by City forces. The County will
reimburse the City for its proportionate share, estimated at $9,500.
The total cost of this project is $28,500. Funding for the City portion will
be from the first $460,000 SB300 Funds already received by the City.
Del Rosa Avenue from Eureka Street to 39th Street is badly in need of rehabil-
itation. We recommend the agreement to be approved.

2 RESOLUT]ON OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO
3 RELATING TO THE RESURFACING OF DEL ROSA AVENUE, FROM EUREKA
STREET TO THIRTY-NINTH STREET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute on behalf of said City
8 an agreement with the County of San Bernardino relating to the
9 resurfacing of Del Rosa Avenue, from Eureka Street to 39th
10 Street, a copy of which is attached hereto, marked Exhibit "A"
1] and incorporated herein by reference as fully as though set forth
12 at length.

SECTION 2. The contract authorized by this resolution shall
14 not take effect until fully signed and executed by both parties.
15 Neither party shall be obligated hereunder unless and until the
16 contract is fully executed and no oral agreement thereto shall be
17 implied or authorized.

IT IS HERE8Y AGREED AS FOllOWS:
(Use space below and additional bond sheets. Set forth service to be rendered, amount to be paid, manner of payment, time
for performance or completion, detennination of satisfactory performance and cause for termination, other terms and
conditions, and attach plans, specifications, and addenda, if any.)
WHEREAS, Del Rosa Avenue between Eureka Street and 39th Street, is in
need of resurfacing to prevent further deterioration of the existing pavement
and to improve riding quality; and
WHEREAS, jurisdiction for operation and maintenance of Del Rosa Avenue
is split between COUNTY and CITY; and
WHEREAS,
participate in
Avenue; and
COUNTY and CITY mutually desire to cooperate and jointly
the proposed resurfacing of the above noted section of Del Rosa
WHEREAS, COUNTY and CITY desire to set forth the responsibilities and
obligations of each agency in relation to the performance of the proposed
resurfacing.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
CITY SHALL:
1. Act as lead agency for the resurfacing of Del Rosa Avenue.
2. Perform the full width resurfacing of Del Rosa Avenue, between
Eureka Street and 39th Street, with an average one (1) inch thickness
of asphalt concrete, and replace traffic striping and pavement
markings.
3. Initially finance the total cost of the proposed resurfacing,
estimated at $28,500.
4. Obtain a no-cost permit from COUNTY for work within the COUNTY'S
right of way.

5. Require its contractors to maintain Worker's Compensation Insurance
on all employees and a Public and Property Liability Insurance
Policy of not less than $1,000,000 combined single limit liability
coverage for bodily injury and/or property damage which shall name
the City of San Bernardino and the County of San Bernardino as
additional insured parties.
COUNTY SHALL:
1. Reimburse the CITY for the cost incurred for resurfacing the
portion of Del Rosa Avenue that is under jurisdiction of the COUNTY
wi thin thirty (30) days after receipt of a billing from the CITY.
The COUNTY'S share shall be the cost of resurfacing the portion of
Del Rosa Avenue under the COUNTY'S jurisdiction, including the
cost of replacing traffic striping and pavement markings, and is
estimated to be $9,500 and shall in no event exceed $11,000 unless
approved in writing by the COUNTY.
BE IT FURTHER AGREED THAT:
1. Neither party to this Agreement nor officers nor employees thereof
shall be responsible for any damage or liability occurring by
reason of anything done or omitted to be done by the other party
to the Agreement under or in connection with any work authority or
jurisdiction not delegated to the parties under this Agreement.
It is also agreed that, pursuant to Government Code Section 895.4,
each party shall fully indemnify and hold the other party harmless
from any liability imposed for injury (as defined by Government
Code Section 810. 8) occurring by reason of anything done or omitted
to be done under or in connection with any work authority of
jurisdiction under this Agreement.
2. Upon completion of the resurfacing, the CITY and COUNTY will
maintain the portion of the work within their respective areas of
jurisdiction.
3. This Agreement may be amended or modified at any time upon mutual
agreement of the parties hereto.
