STAFF REPORT
The City of San Bernardino has requested the County of San Bernardino partic-
ipate in the cost of resurfacing Palm Avenue from Highland Avenue to Citrus
Street. Approximately 54% of this section is within the corporate limits of
the City of San Bernardino. City portions are from Highland Avenue north to
Orchid Drive (both sides) and from north of Pumalo Street to Citrus Street.
The proposed agreement provi des, in general, that the City wi 11 act as 1 ead
agency and the resurfacing will be performed by City forces. The County will
reimburse the City for its proportionate share, estimated at $12,700.
The total cost of this project is $27,900. Funding for the City portion will
be from the first $460,000 SB300 Funds already received by the City.
Palm Avenue from Highland Avenue to Citrus Street is badly in need of rehabil-
itation. We recommend the agreement to be approved.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION CF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO
3 RELATING TO THE RESURFACING OF PALM AVENUE, FROM HIGHLAND AVENUE
TO CITRUS STREET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute on behalf of said City
8 an agreement with the County of San Bernardino relating to the
9 resurfacing of Palm Avenue, from Highland Avenue to Citrus
10 Street, a copy of which is attached hereto, marked Exhibit "A"
11 and incorporated herein by reference as fully as though set forth
12 at length.

SECTION 2. The contract authorized by this resolution shall
14 not take effect until fully signed and executed by both parties.
15 Neither party shall be obligated hereunder unless and until the
16 contract is fully executed and no oral agreement thereto shall be
17 implied or authorized.

(Use space below and additional bond sheets. Set forth service to be rendered, amount to be paid, manner of payment, time
for performance or completion, detennination of satisfactory performance and cause for termination, other terms and
conditions, and attach plans, specifications, and addenda, if any.)
WHEREAS, Palm Avenue between Highland Avenue and Citrus Street, is in
need of resurfacing to prevent further deterioration of the existing pavement
and to improve riding quality; and
WHEREAS, jurisdiction for operation and maintenance of Palm Avenue is
split between COUNTY and CITY; and
WHEREAS,
participate in
Avenue; and
COUNTY and CITY mutually desire to cooperate and jointly
the proposed resurfacing of the above noted section of Palm
WHEREAS, COUNTY and CITY desire to set forth the responsibilities and
obligations of each agency in relation to the per formance of the proposed
resurfacing.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
CITY SHALL:
1.
Act as lead agency for the resurfacing of Palm Avenue.
2.
Perform the full width resurfacing of Palm Avenue, between Highland
Avenue and Citrus Street, with an average one (1) inch thickness
of asphalt concrete, and replace traffic striping and pavement
markings.
3.
Initially finance the total cost of the proposed resurfacing,
estimated at $27,900.
4.
Obtain a no-cost permit from COUNTY for work wi thin the COUNTY'S
right of way.

5. Require its contractors to maintain Worker's Compensation Insurance
on all employees and a Public and Property Liability Insurance
Policy of not less than $1,000,000 combined single limit liability
coverage for bodily injury and/or property damage which shall name
the City of San Bernardino and the County of San Bernardino as
additional insured parties.
COUNTY SHALL:
1. Reimburse the CITY for the cost incurred for resurfacing the
portion of Palm Avenue that is under jurisdiction of the COUNTY
within thirty <30 l days after receipt of a billing from the CITY.
The COUNTY'S share shall be the cost of resurfacing the portion of
Palm Avenu~ under the COUNTY'S jurisdiction, including the cost of
replacing traffic striping and pavement markings, and is estimated
to be $12,700 and shall in no event exceed $14,000 unless approved
in writing by the COUNTY.
BE IT FURTHER AGREED THAT:
1. Neither party to this Agreement nor officers nor employees thereof
shall be responsible for any damage or liability occurring by
reason of anything done or omitted to be done by the other party
to the Agreement under or in connection with any work authority or
jurisdiction not delegated to the parties under this Agreement.
It is also agreed that, pursuant to Government Code Section 895.4,
each party shall fully indemnify and hold the other party harmless
from any liability imposed for injury (as defined by Government
Code Section 810.8loccurring by reason of anything done or omitted
to be done under or in connection with any work authori t y 0 f
jurisdiction under this Agreement.
2. Upon completion of the resurfacing, the CITY and COUNTY will
maintain the portion of the work within their respective areas of
jurisdiction.
3. This Agreement may be amended or modified at any time upon mutual
agreement of the parties hereto.
