STAFF REPORT
The County of San Bernardino has requested that we participate in the cost of
resurfacing Baseline Street from Sterling Avenue to Victoria Avenue. Approx-
imately 16% of this section is within the corporate limits of the City of San
Bernardino. City portions are the north side of Baseline Street from the app-
roximate vicinity of Blythe Avenue east to Hill Road.
The proposed agreement provides, in general, that the County will act as lead
agency and the resurfacing performed under contract. The City will reimburse
the County for its proportionate share, estimated at $18,000.
The total cost of this project is $106,000. Funding for the City portion will
be from the first $460,000 SB300 Funds already received by the City.
Baseline Street from Sterling Avenue to Victoria Avenue is badly in need of
rehabilitation. We recommend the agreement to be approved.

EXECUTION OF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO
3 RELATING TO THE RESURFACING OF BASE LINE STREET, FROM STERLING
AVENUE TO VICTORIA AVENUE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of Scin Bernardino is
7 hereby authorized and directed to execute on behalf of said City
8 an agreement with the County of San Bernardino relating to the
9 resurfacing of Base Lin~ Street, from Sterling Avenue to Victoria
10 Avenue, a copy of which is attached hereto, marked Exhibit "A"
11 and incorporated herein by reference as fully as though set forth
12 at length.
13 SECTION 2. The contract authorized by this resolution shall
14 not take effect until fully signed and executed by both parties.
15 Neither party shall be obligated hereunder unless and until the
]6 co~tract is fully executed and no oral agreew.Ent thereto shall be
17 implied or authorized.

IT IS HEREBY AGREED AS FOLLOWS:
(Use space below and additional bond sheets. Set forth service to be rendered, amount to be paid, manner of payment, time
for performance or completion, determination of satisfactory performance and cause for termination, other terms and
conditions, and attach plans, specifications, and addenda, if any.)
WHEREAS, Base Line Street between Sterling Avenue and Victoria Avenue,
is in need of resurfacing to prevent further deterioration of the existing
pavement and to improve riding quality; and
WHEREAS, jurisdiction for operation and maintenance of Base Line Street
is split between COUNTY and CITY; and
WHEREAS, COUNTY and CITY mutually desire to cooperate and jointly
participate in the proposed resurfacing of the above noted section of Base
Line Street; and
WHEREAS, COUNTY and CITY desire to set forth the responsibilities and
obligations of each agency in relation to the performance of the proposed
resur fac ing.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
COUNTY SHALL:
1. Act as lead agency for the resurfacing of Base Line Street.
2. Perform the full width resurfacing of Base Line Street, between
Sterling Avenue and Victoria Avenue, with an average 0.15 foot
thickness of asphalt concrete, and replace traffic striping and
pavement markings.
3. Initially finance the total cost of the proposed resurfacing,
estimated at $106,600.
4. Obtain a no-cost permit from CITY for work within the CITY'S
right of way.

5. Require its contractors to maintain Worker's Compensation Insurance
on all employees and a Public and Property Liability Insurance
Policy of not less than $1,000,000 combined single limit liability
coverage for bodily injury and/or property damage which shall name
the City of San Bernardino and the County of San Bernard ino as
additional insured parties.
CITY SHALL:
1. Reimburse the COUNTY for the cost incurred for resurfacing the
portion of Base Line Street that is under jurisdiction of the CITY
within thirty (30) days after receipt of a billing from the COUNTY.
The CITY'S share shall be the cost of resurfacing the portion of
Base Line Street under the CITY'S jurisdiction, including the
cost of replacing traffic striping and pavement markings, and is
estimated to be $15,000 and shall in no event exceed $18,000 unless
approved in writing by the CITY.
BE IT FURTHER AGREED THAT:
1. Neither party to this Agreement nor officers nor employees thereof
shall be responsible for any damage or liabil i ty occurr i ng by
reason of anything done or omitted to be done by the other party
to the Agreement under or in connection with any work authority or
jurisdiction not delegated to the parties under this Agreement.
It is also agreed that, pursuant to Government Code Section 895.4,
each party shall fully indemnify and hold the other party harmless
from any liability imposed for injury (as defined by Government
Code Section 810.8) occurrin;) by reason of anything done or omitted
to be done under or in connection with any work authority of
jurisdiction under this Agreement.
2. Upon completion of the resurfacing, the CITY and COUNTY will
maintain the portion of the work within their respective areas of
jurisdiction.
3. This Agreement may be amended or modified at any time upon mutual
agreement of the parties hereto.
