"",", '- ......J' Memorandum of Understanding This memorandum sets forth the functional and accountable relationships of the Risk Management Director, City Attorney, and City Administrator. The City Attorney, by Charter, shall represent, advise and defend all legal actions brought by or against the City. Included, but not all inclusive, are Liability Claims, Workers Compensation Claims, and Disability Claims. There is and shall continue to be a Risk Management Division in the City Administrator Department. The functional and admin- istrative leadership of the Risk Manager and the Risk Management Division shall be provided by the City Administrator, excluding litigation and claims settlement as defined below. , ",'-'...." ,.f_;uv. ,,',{(.1..)',I'. The Risk Manager shall (. /- . d..{ ;" " !\ , .' be accountable to the City Attorney for the legality and quality of claims settlement and claims investigation on cases resulting in or likely to result in litigation, and for the personnel in- volved in those areas. Claims settlement includes liability, pro- perty, workers compensation, and disability claims. The City Administrator, or his designee, shall provide direction to Risk Manager in all other aspects of the Risk Management Division activity. The Risk Manager shall be accountable to the City Administrator for all policy and budget matters of the division. @ - - r.' .......
