AUTHORIZATION TO PROCEED; RESOLUTION OF
INTENTION: Vacation of the alley West of
"H" Street, South of Esperanza Street.
Synopsis of Previous Council action:
10/05/87 --- Finding of need for health and safety was adopted; Plan No. 7253 was
approved. The Negative Declaration of Environmental Impact and a finding
of consistency with the general plan were adopted.
Recommended motion:
1) That the City Engineer and the City clerk is authorized to proceed with the vacation
of that certain East/West alley West of "H" Street and South of Esperanza Street.
2) Adopt Resolution

RESOLUTI ON NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF THAT CERTAIN EAST/WEST ALLEY WEST OF "H" STREET,
SOUTH OF ESPERANZA STREET AND RESERVING PUBLIC UTILITY EASEMENT AND AN
EASEt1ENT FOR SANITARY SEWER AND APPURTENANT FACILITIES THEREON; ALSO
RESERVING AN EASEMENT FOR ACCESS TO THE CALIFORNIA DEPARH1ENT OF
TRANSPORTATION.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the Ci ty of San
Bernardino hereby declares its intention to order the vacation of that
certain East/Vlest Alley West of "H" Street, South of Esperanza Street, and
reservi ng pub 1 i c uti 1 i ty easements and an easement for sanitary sewer and
appurtenant facilities and an easement for access to the California
Department of Transportation, described as follows:
Beginning at the Southeast corner of Lot 1, Block 3 of
Urbita Subdivision, as per map recorded in Book 3 of
Maps, page 54, records of the County Recorder of San
Bernardino County, State of California; thence West,
along the South lines of Lots 1, 2 and 3 of said Block, a
distance of 163.47 feet more or less, to the East line of
Interstate Highway 215; thence South, along the said
East line, to a point on a line that is 16 feet south of
and parallel with the south lines of said lots 1, 2 and
3; thence East along said parallel line, to it's
intersection with the Southerly prolongation of the East
line of said Lot 1; thence north, along said
pro 1 onga ti on, to the Poi nt of Begi nni ng.
SECTION 2. That the Mayor and Common Council of the City of San

Bernardino, in vacating the above described portion of said street ,elects
to proceed under and in accordance with the provisions of the "Public
Streets, Highways and Services Vacation Law", being Division 9, Part 3, of

the Streets and Highways Code of the State of California.
SECTION 3. That the hour of 10:00 A.M. on the 1st day of
February, 1988, in the Council Chamber of the City Hall, San Bernardino,
California, be, and the same hereby is fixed as the time and place when and

where all persons interested in or objecting to the proposed vacation may
appear before the said Mayor and Common Council and offer evidence in
relation thereto. For further particulars as to the proposed vacation of
the hereinbefore described portion of said street, reference is made to that
certain map marked "Plan No. 7253" approved October 5,1987, on file in
the offi ce of the City Clerk of sa i d Ci ty.
SECTION 4. Nothing in this Resolution shall in any way affect or
disturb any existing easements for sanitary sewer and appurtenant facilities
and for public utility purposes belonging either to the City of San
Bernardi no or to any pub 1 i c uti 1 ity and there is hereby reserved for future
general public utility purposes and for this City an easement reasonably
necessary to locate such sanitary sewer and public utility facilities over,
in, under or across the real property hereinabove described and to use,
maintain, repair, replace or renew such facilities; and an easement for
access to the California Department of Transportation.
SECTION 5. That the City Engineer of the City of San Bernardino
hereby is directed to cause Notices of Street Vacation to be posted as
required by the Public Streets, Highways and Services Vacation Law.
SECTION 6. That the City Clerk shall certify to the adoption of
this Resolution of Intention and shall cause the same to be published once a
week for two successive weeks in The Sun, a newspaper publ ished and
circulated in the City of San Bernardino, prior to the date of the above
public hearing.
