LICB" . AND REPEALING RESOLUTION NO. 87-l6.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION l. Recitals.
A. Penal Code Sections lllOS(b) (lO) and l3300(b) (lO)
authorize cities, counties, and districts to access state and
local summary criminal history information for employment,
licensing, or certification purposes.
B. Penal Code Sections lllOS(b) (10) and l3300(b) (10)
~
require that there be a requirement or exclusion from emPl~~t.
licensing, or certification based on specific criminal conQjat,on-
the part of the subject of record.
C. Penal Code Sections lllOS(bl llO) and l3300(b) <lO)
require the city council to specifically authorize access to
summary criminal history information for employment, licensing,
or certification purposes.
SECTION 2. Restrictions.
A. The City shall not consider a person who has been
conyicted of a felony or a misdemeanor involving moral turpitude
eligible for employment or licensing, ex 'ept that such conviction
may be disregarded if it is determined that mitigating
circumstances exist, or that the conviction is not related to the
25 employment or license in question.
26 B. A prospective employee of the City or an applicant for
27 licensing or certification shall be fingerprinted by the Police

Department or Personnel Department if requested by the City
official responsible for filling employment vacancies.
C. City officials responsible for filling employment,
certification or licensing duties are hereby authorized to access
summary criminal conviction history information for employment,
licensing or certification purposes.
