Bids for this project were opened at 2:00 p.m. on Tuesday,
11-24-87.
A total of 5 bids were received, ranging from $348,680.80
to $460,236.03, for the Basic Bid. The low bid of $348,680.80 is
11.5% over the Engineer's Estimate of $312,656.00.
Deductive Change Order No. One has been negotiated with
the low bidder. This Change Order reduces the contract price by
an estimated amount of $20,204.50, from $348,680.80 to $328,476.30,
by substituting a chain link backstop for an arch type, deleting
P.C.C. mow strip, 6-foot chain link fence along south boundary
line (except adjacent to existing residence) and hydrospraying
(grass on Little League Field).
Listed below is an estimate of the total project cost,
based upon the actual low bid price less Change Order No. One.

Even though 5 bids were received, none of the local contrac-
tors that have done park projects in the past submitted a bid. For
this reason, we have some doubt that the low bid is the best that
we can reasonably expect to receive. Also, some items have been
found that could be re-designed, and affect some cost reductions.
An effort is being made to identify a source of supplemental
funding. If this effort is successful, some of the items deleted
by Change Order No. One, or some of the 8 Additive Alternates in
the bid schedule, could be added to the contract.
URGENCY CLAUSE
A decision on the disposition of this contract must be made at the
Council Meeting of 12-07-87. in order to have a reasonable chance
of having the Little League Baseball Field in a playable condition
by the start of the next season.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO BO PARK ENTERPRISE, INC. FOR IMPROVEMENT OF RIO VISTA
3 (ANNE SHIRRELLS) PARK, PHASE II-B, AND APPROVING DEDUCTIVE CONTRACT
CHANGE ORDER NO. ONE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Bo Park Enterprise, Inc. is the lowest
7 responsible bidder for: Improvement of Rio Vista (Anne Shirrells)
8 Park, Phase II-B, in accordance with Plan No. 703B, for the total
9 amount of $348,680.80; a contract is awarded to said bidder
10 accordingly for the Basic Bid, but such award shall be effective
11 only upon the contract being fully executed by the parties; all
12 other bids therefor are hereby rejected; and the Mayor is hereby
13 authorized and directed to execute said contract on behalf of the
14 City; a copy of the contract is attached hereto, marked Exhibit
15 "A" and incorporated herein by reference as fully as though set
16 forth at length.

SECTION 2. Contract Change Order No. One is hereby
18 approved to authorize various substitutions and deletions in the
19 items of work, for a' net decrease in the contract price of
20 $20,204.50, from $348,680.80 to $328,476.30.

SECTION 3. Execution and Amendments. This contract and
22 any amendments or modifications thereto shall not take effect or
23 become operative until fully signed and executed by the parties
24 nd no party shall be obligated hereunder until the time of such
25 ull execution. No oral agreements, amendments, modifications or
26 aivers are intended or authorized and shall not be implied from
27 ny act or course of conduct of any party.

2 Depart.-ent of Housing and Urban Development (HUD). This contract

6 party shall be obligated hereunder until the time of such full
7 execution. No oral agreements, amendments, modifications or
