DESCRIPTION) Finance: Council Notas: 75.0212 Agenda Item No. :2';b ) CI-W OF SAN BERNARD~O - REQU~T FOR COUNCIL Ac110N STAFF REPORT On July 5, 1985, the Ci ty acquired a parcel of land at the Southeast corner of State Street and Kendall Drive, described as Lot 1 of Tract No. 3177. On September 17, 1985, the City acquired an adjacent parcel, described as Lot 1 of Tract No. 12674. Both of these parcels were acquired by a Quitclaim Deed, and there were no costs involved with the acquisition. These two parcels of land were given to the Ci ty for Water Department use and in exchange, the City was to bear the cost of undergroundi ng the overhead uti 1 i ti es when the enti re tract was to be developed. The cost for the undergroundi ng was then estimated to be $40,000.00. The tract was never developed, and was subsequently sold to Universi ty Square, a Joint Venture, who has submitted plans to the City for development. University Square wishes to acquire the two parcels of land from the City. As stated above, the two parcels were to be used by the Water Department for the construction of a booster station, which has never been built. The subject parcels are a liability and a nuisance to the City, since they are vacant parcels that require constant maintenance and weed abatement services. The properties are encumbered by pipeline and other utility easements, which strictly limit the use and marketability of the land. The owner of the tract will bear the costs for undergrounding the overhead utilities, and, if acquired from the City, will use the land for parking purposes and has indicated the he will landscape the remaining portion of the parcels, which will add to the aesthetics of the area. Further, the owner will convey to the City, an approximate 40 foot by 40 foot parcel of land for Water Department use, for the construction of a booster station. 8ased on the above, we recommend that the Mayor be authorized and directed to execute said Quitclaim Deeds. A RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A QUITCLAIM DEED FOR TWO PARCELS LOCATED ON THE SOUTHEAST CORNER OF UNIVERSITY PARKWAY AND KENDALL DRIVE. BE IT RESLOVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: That the City of San Bernardino execute a Quitclaim Deed to University Square, a Joint Venture, for two parcels of land located on the Southeast corner of University Parkway and Kendall Drive, that is no longer needed by the City of San Bernardino. SECTION TWO: That the said Quitclaim Deed referred to herein, a copy of which is attached hereto, marked Exhibit "A", and is hereby referred to and made a part hereof as fully as though set out at length herein, is hereby approved. SECTION THREE That the Mayor of the City of San Bernardino is hereby authorized and directed to execute said Quitclaim Deed on behalf of the City of San Bernardino.
