I CI"F~ OF SAN BERNARD'."O - REQUF~T FOR COUNCIL AC~ON STAFF REPORT BACKGROUND On October 6, 1987, the Planning Commission, after conducting a properly noticed public hearing, approved Conditional Use Permit 87-54 to construct a little league ball park at the Rio Vista Regional Park subject to conditions. The proposed ball park is located on the east side of Pennsylvania Avenue, approximately 300 feet north of Baseline. Condition number 1, reads: "1. A six foot block wall shall be constructed on the south property line the length of the adjacent residential parcel, stepping down to a height of three feet in the 25 foot front setback area." This condition was imposed by the Environmental Review Committee as a mitigation measure to provide a ground noise barrier for the adjacent residence. This condition has been appealed by Annie Ramos, Director of Parks, Recreation and Community Services. (See Attachment B.l ANALYSIS In considering the request to construct a ball park in a residential neighborhood, the Environmental Review Committee reviewed the potential impacts, including noise, on the adjacent residences. An announcer's booth is proposed and will be wired for a sound system, but the system will not be installed until a later date. The ground noise from the ball teams and the spectators in the bleachers was determined to be a potential impact to the adjacent residence to the south. The driveway to the parking lot is located next to the residence and that too would impact the occupants of the residence. The residence on the property is owner occupied. At the time the condition was imposed, the Planning Department was not aware that the intention of the City was to purchase the adjacent property to the south for future park expansion. This was not discussed at the public hearing conducted by the Planning Commission. There are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended uses of the property, which do not apply generally to other property in the same zoning district and neighborhood, in that the proposed use is a City park and the 25 foot setback for a single family- residence would be inappropriate if applied to struc- tures in a park. 2. That such a Variance is necessary for the preservation and enjoyment of a substantial property right of the applicant in that the overall plan for the park includes additional facilities in the remaining vacant areas. These facilities could not be fully developed if adherence to the 25 foot setback standard is required. 3. That the granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in that the zoning district and neighborhood in which the property is located in that with the proposed 22 foot setback from curb face, sight distance will not be impaired for vehicular or pedestrian traffic. 4. A single or double door shall be equipped with a double or single cylinder dead bolt. The bolt shall have a minimum projection of I" and be constructed so as to repel cutting tool attack. b. The dead bolt shall have an embedment of at least 3/4" Into the strike receiving the projected bolt. Ramos, Director Parks, Recreation and Community Services October 9, 1987 Date Approved Date The Planning Commission has approved a condition imposed by the ERC for a 6 foot waIl on the south property line the length of the residential parcel bordering Phase lIB development of Anne Shirrells Park. The purpose of this block fence is to reduce ground noise from the ballfield to the adjacent resident. The department wishes to appeal this condition based on the following factors: 1. Construction cost is estimated at $7,500. The adjoining property is for purchase for future park development. Purchase may be as soon as 18 months away. The block wall consequently would be only temporary and an inappropriate use of funds. 2. There is only a single residency to be protected by this construction which is located over 250 feet away from the announcers booth. There can be other measures taken, such as mounting speakers directionally to mitigate noise to the residency, that would be just as effective and far less expensive. 3. The use of the ballfield is seasonal (approximately 10 to 12 weeks) and the solution to the problem is year-round and consequently impractical. 4. There are numerous other ballfields in the city where residences are located within 250 feet of the announcers booths. REQUEST The applicant requests approval under authority of San Bernardino Municipal Code Section 19.78.020 (14l to construct a little league ball field with a concession stand, announcers' booth, field lighting and parking. Included in the request is a waiver of San Bernardino Municipal Code Section 19.08.060 (Al. Front setback requirements in the R-1-7200, Single Family Zone to permit the concession stand, two sets of bleachers, and the refuse enclosure to be built on the property line, which is 22 feet behind the curb. 2. LOCATION The subject site is located approximately 370 feet north of Baseline on the west side of Pennsylvania Avenue on two parcels totalling approximately 2.1 acres. The site is adjacent to the southerly boundry of the existing Rio vista Park. (See Attachment "D".l 3. MUNICIPAL CODE A~ID GENERAL PLAN CONFORMANCE The subject site and surrounding property are zoned R-l- 7200, Single Family Residential. The General Plan, through GPA 82~2, designates the site for parks and recreation. Land use south, east, and west is single family residential. North is an existing park (Rio vista Phase Il and north of the park is a school (See Attachment Al. Section 19.08.060 (Al of the San Bernardino Muncipal Code requires a front setback of not less than 25 feet in the R-I-7200 zone. The applicant requests to waive this requirement to allow full development of the propose~ ball field. The proposal is to allow the conceSS10n stand, two sets of bleachers, and the refuse enclosure to be built on the property line, which is ~ feet behind the curb. ;) oj 4. ENVIRONMENTAL CLEARANCE The item was before the Environmental Review Committee on September 10, 1987. Discussion items were noise, traffic, parking, lighting and liquefaction. Noise - when a sound system is installed, noise levels will be monitored and will not exceed 60 decibels at any property line zoned residential. A block wall will be constructed along the south property line to provide a ground noise barrier for the existing residence. The park will close by 10:00 p.m. each day. B. Traffic in an effort to mitigate traffic congestion due to curb side parking, the Environmental Review Committee recommended a fence be constructed along the periphery of the ball field parallel to Pennsylvania with pedestrian access at points in the outfield. This will encourage use of the on-site parking lot instead of the street. This measure has been appealed by the Director of Parks and Recreation Department. (see memo Attachment F). C. Lighting it was determined that with proper alignment of the field lights there will be no glare to the adjacent properties. D. Liquefaction the liquefaction study concluded that this site is not susceptible to liquefaction. A proposal to adopt a Negative Declaration was made September 17, 1987, at the Environmental Review Committee meeting~ The proposal and initial study were advertised and made available for public review. No comments were received. 5. BACKGROUND Through the Office of Planning and Research Letter of August 3, 1987, Public Works projects were excepted from the imposed moritorium if it could be found that the project is necessary for the health, safety and general welfare of the citizens of San Bernardino. Those findings were prepared by Roger Hardgrave, City Engineer, and adopted by the Mayor and,Common Council at their meeting of September 21,1987 (See Attachment G). ANALYSIS The proposed little league field will provide four permanent bleachers to accommodate 328 people. The concession stand will be built of concrete block and will be located approximately 22 feet in back of the curb where as 47' is required to meet the 25' structural setback required by code. The concession stand and two sets of bleachers will be located on the property line. The announcers' booth will be supplied with conduit for a sound system. However, at this time no sound system is proposed. Sixty parking spaces are proposed on the perimeter of the outfield. The City has no standard for parking for a ball field. A telephone survey to other jurisdictions revealed that a common standard is a ratio of one parking space per five fixed seats. Based on that ratio, sixty-six spaces would be required. It has been determined that the sixty spaces proposed will be adequate. Access to these spaces are from a 24 foot commercial driveway on Pennsylvania Avenue which leads to an internal park road. The road will be connnected to a similar road which circulates through the existing park to the north with access on California Street (See Attachment H). 7. CONCLUSIO!'l The proposed development is consistent with the general plan which designates the site for Parks/Recreation. The State has determined that it is the responsiblity of jurisdiction to provide better parks and enhanced recreational facilities to contribute to the healthy physical and moral environment for the citizens of California. The requested setback waiver and the proposed use, if constructed under conditions imposed and subject to the recommended mitigation measures of the Environmental Review Committee, will not be detrimental to the citizens of San Bernardino. '., 3.2 Site and Project Characteristics 3.2.1 Existing Conditions The site is a approximately be developed graded vacant rectangularly-shaped, flat parcel encompassing 4.3 acres. Approximately 45% of the site will at this time. The site is currently a rough field (see site plan, Exhibit "B"l. 3.2.2 Project Characteristics The proposed development will encompass approximately 2.1 acres of the total site. It includes a ball field, con- cession stand with announcer's booth, 328 fixed seats in four sets of bleachers, fencing, and 66 parking spaces. The project will require approximately 100 cubic yards of cut and fill. Pennsylvanie Avenue will be improved with curb and gutter. 3-1 c /,,". ,1""'\ Initial Study - Con~ional Use Pe~t No. 87-54 Little League Ball Field - Rio Viseb Park September 16, 1987 -J 4.0 ENVIRONMENTAL ASSESSMENT " 4.1 Environmental Setting The subject site is a rectangularly-shaped parcel of land encompassing approximately 4.3 acres of which approximately 2.2 acres will remain vacant and 2.1 acres will be developed. The site is bounded on the east by pennsylvania Avenue and by California Street on the west, both collector streets which lead southerly to BAseline Street, an arterial street. To the east and west exist single-family subdivisions. To the north is the existing phase of the park. The site and surrounding areas are zoned R-I-7200. 4.2 Environmental Effects The Environmental Impact Checklist identifies two areas of potential concern regarding the project, with two additional concerns raised by the City of San Bernardino. These four concerns include: Increased noise levels resulting from the completed proj ect. Traffic hazards or congestion caused by the loca- tion and adequacy of the parking. The possibility of glare and light proposed field lights. The subject site is located in an area identified as susceptible to liquefaction. from the The Environmental Impact Checklist is attached in Appendix A of this report. Each item checked "maybe" on the checklist is identified below, followed by the recommended mitigation measures. 2. Would significant increases in noise levels, dust, odors, fumes, vibration, or radiation be generated from the project area, either during construction or from the completed project other than those resulting from normal construction activity? Based on Table 7-1 from the Noise Control Office of the State of California, acceptable levels of noise in a single- or two-family land use area are 50 decibels from 10:00 p.m. to 7:00 a.m. and 60 decibels from 7:00 a.m. to 10:00 p.m. (see Exhibit C, Table 7-1). The ball park will be closed at 10:00 p.m. each evening. 2. The decibel level prior to 10:00 p.m. at any property line zoned residential shall not exceed 60 decibels. This can be accomplished by monitoring noise levels during a game and adjusting the sound system if necessary. 3. A concrete wall will be constructed on the southerly line of the ball field to reduce ground noise to the adjacent residences. 6. Could the project create a traffic hazard or congestion? It was determined by the Traffic Engineer that the traffic generated by the ball field would not be a problem. The concern was based on the possibility of cars not using the provided parking to the rear of the outfield, but using curbside parking on Pennsylvania Avenue due to its relative convenience to the proposed bleachers. Also of question, was the adequacy of the number of proposed parking spaces. The recommended mitigation measures are: ,Construct a fence on the periphery of the ball field with pedestrian access points only from the outfield side of the ball park adjacent to the parking lot. The access points will consist of gates outside both the 'first and third base lines. The fence on the easterly line of the field will parallel Pennsylvania Avenue and have no access to the bleachers except at the southerly line of the gate at the first base line in the outfield. The fences and gates will encourage use of the 60 parking spaces proposed on the site plan. The 60 spaces will be adequate to provide parking for the proposed 328 seats. The glare from the proposed lighting was identified as a possible concern. It was determined that with proper align- ment onto the field, the lights will not shine onto surround- ing properties. The lights will be placed on a permanent timer with shut-off set for 10:00 p.m. each night. C.lN.~. / . c f, ( ( ( (: ( (. p'., ColNo",). .N--'" ~ - PRELIMINARY SOILS INVESTIGATION CONCESSION BUILDING RIO VISTA PARK PENNSYLVANIA AVENUE AND l3TH STREET SAN BERNARDINO, CALIFORNIA PREPARED FOR CITY OF SAN BERNARDINO JOB NO. 87698-3 SCOPE During, June and July of 1987, a Preliminary Soils Investigation for the proposed COncession Building to be located in Rio Vista Park, San Bernardino, California, was performed by this firm. The purpose of this investigation was to explore and evaluate the geotechnical conditions at the subject site and to provide engi- neering recommendations for site grading, foundation design for the proposed structure and support of concrete slabs-on-grade. To orient our investigation at the site, a 50-scale Site Plan, Drawing No. 7038, Sheet 2, undated, was furnished for our use. The location of the site is shown on the attached Index Map (Enclosure "A-l"). The results of our investigation, together with our conclusions and recomm"ndations, are presented in this report. PROJECT CONSIDERATIONS Information furnished this office indicates that the subject site will be developed with a concrete block building having a 24 foot by 32 foot first floor and an 8 foot by 12 foot second floor. The first floor will be used for concession, restroom and storage. '" Job No. 87698-3 The project grading plan was not available at the time of our investigation. However, inspection of site topography and of adjacent developments indicates that development of this site will entail minimal cuts and fills. SITE DESCRIPTION The subject site is bounded on the east by Pennsylvania Avenue, the north be existing park facilities and the south and west by vacant land. The ground surface is near planar and has a Slight Slope down to the south. At the time of our investigation, the site contained a growth of weeds to approximatelY 18 inches high and traces of trash. FIELD AND LABORATORY INVESTIGATION The soil conditions underlying the subject site were explored by means of three exploratory borings drilled to depthS of 50 and 12 feet belOW the existing ground surface with a truck-mounted CME 55 drill rig equipped for soil sampling. The approximate locations of our exploratory borings are indicat~d on the attached Plat (Enclosure "A-2"). Continuous logs of the subsurface conditions, as encountered within the exploratory borings, were recorded at the time of drilling by a staff geOlogist from this firm. Relatively undis- turbed samples were obtained by driving a split spoon ring sampler and/or a Standard Penetration Test (SPT) sampler ahead of the borings at selected levels. The number of hammer blOWS required to advance the sampler a total of 12 inches was converted to SPT ( c "( , ',( , ( ( ( ,;( ;= l ....'" """ 1 ...,; C.[H., fl. -- .. Job No. 87698-3 blowcounts, and recorded on the boring logs. Undisturbed samples as well as bulk samples of typical soil types were obtained and 'returned to the laboratory in sealed containers for testing and evaluation. Our exploratory boring logs, together with our mOisture-density data, are presented on Enclosures "B-1" through "B-3". The strat- ification lines presented on the boring logs represent the approx- imate boundaries between soil types, which may include gradual transitions. Included in our _ laboratory testing program were field moisture content determinations on all samples returned to the laboratory and field dry densities on all undisturbed samples. The results are included on the boring logs. SUBSURFACE SOIL CONDITIONS Data from our exploratory borings indicate that the site consists of, one to .two. feet of:' silty sand overlying poorly to well:graded sand and gravel. Based on the results of our Standard Penetration Tests, the upper three to four feet of soil are in a lOOS~ to medium dense state. The underlying soils were found to be in a medium dense to dense state. No groundwater was encountered in any of the borings to the maxi- mum depths attained which was 50 feet. Considerable caving of the exploratory bore holes occurred upon removal of the drill auger. c (. ( 'co ( ( ( c ( v. "'."'. Page 4 C.[N].~. - ........ .. Job No. 87698-3 CONCLUSIONS On the basis of our field and laboratory investigations, it is the opinion of this firm that the proposed development is feasible from a soil engineering standpoint, provided the recommendations contained in this report are implemented during grading and con- struction. Based upon our field investigation and test data, it is our opin- ion that the upper native soils will not, in their present condi- tion, prQvide uniform or adequate support for the proposed struc- ture. Our SPT test data indicated variable in-situ conditions of the native soilS, ranging from loose to medium dense states. This condition may cause unacceptable differential and/or overall settlements upon application of the anticipated foundation loads. Site clearing can be expected to further aggravate the settlement- prone conditions. To provide adequate support for the proposed structure, it is our recommendation that the building area be subexcavated as necessary and recompacted to provide a c?mpacted fill mat beneath footings and slabs. A compacted fill. mat wil.l. provide a dense, uniform, . high~strength soil. l.ayer to distribute the foundation l.oads over the underl.ying soil.s. In addition, construction of a compacted fil.l. mat shoul.d ensure removal. and recompaction or densification of any disturbed soil.s. Job No. 87698-3 RECOMMENDATIONS GENERAL SITE GRADING: It is imperative that no clearing and/or grading operations be performed without the presence of a representative of this firm. An on-site, pre-job meeting with the developer, the contractor and the soils engineer should occur prior to all grading related operations. Operations undertaken at the site without the soils engineer present may result in exclusions of affected areas from the final compaction report for the project. Grading of the subject site should be performed in accordance with these recommendations, as well as applicable portions of Chapter 70 of the Uniform Building Code or applicable local ordinances. The following recommendations are presented for your assistance in establishing proper grading criteria. INITIAL SITE PREPARATION: All areas to be graded should be stripped of significant vegeta- tion and other deleterious materials. These materials should be removed from the site for disposal. Any existing man-made fills encountered during construction should be completely removed, cleaned of sig~ifi~ant deleterious materi- als and may be reused as compacted fill. Cavities created by removal of any subsurface obstructions should be thoroughly cleaned of loose soil, organic matter and other deleterious materials, shaped to provide access for construction equipment, and backfilled as recommended for site fill. ( PREPARATION OF FOOTING AREAS: All. footings should rest upon at least l2 inches of properly compacted fill material. In areas where the required thickness is not accomplished by site rough grading, the footing areas should be subexcavated to a depth of at least l2 inches below the pro- posed fQoting base grade, with the subexcavation extending at least five feet beyond the footing lines. The bottom of this excavation should then be scarified to a depth of at least ,12 inches, brought to near optimum moisture content, and recompacted to at least 90 percent relative compaction (ASTM D 1557-70) prior to refilling the excavation to grade as properly compacted fill. 'J' ( ( COMPACTED FILLS: The on-site soils should provide adequate quality fill material, provided they are free from organic matter and other deleterious materials. Unless approved by the soils engineer, rock or similar irreducible material. with a maximum dimension greater than eight inches shoul.d not be buried or placed in fill.s. In order to verify this, additional evaluation of soils for expansion potential should be conducted by this firm during the grading operation. FOUNDATION DESIGN: If the site is prepared as recommended, the proposed structure may be safely founded on conventional spread foundations, either individual spread footings and/or continuous wall footings, bear- ing on ~ minimum of 12 inches of compacted fill. Footings should be a minimum of 12 inches wide, and should be established at a minimum depth of 12. inches below lowest adjacent:, final subgrade level. For the minimum width and depth, footing~ may be designed for a maximum safe soil bearing pressure of 1500 pounds per square foot (psf) for dead plus live loads. This bearing value may be increased by one-third for wind or seismic loading. For footings thus designed and constructed, we would anticipate a maximum settlement of less than 1/2 inch. . LATERAL LOADING: Resistance to lateral loads will be provided by passive earth pressure and basal friction. For footings bearing against com- pacted fill, passive earth pressure may qe considered to be deve- loped at a rate of 250 pounds per square foot per foot of depth. Basal friction may be computed at 0.35 times the normal dead load. Basal friction and passive earth pressure may be combined without reduction. Foundation concrete should be placed in neat excavations with vertical sides, or the concrete should be formed and the excava- tions properly backfilled, as recommended for site fill. . - "- ( ,(, . The final pad sur- faces should be rolled to provide smooth, dense surfaces upon which to place the concrete. Slabs to receive moisture-sensitive coverings should be provided wi th a moisture vapor barrier. This barrier may consist of an impermeable membrane. Two inches of sand over the membrane will reduce punctures and aid in obtaining a satisfactory concrete cure. Tl}e sand should be moistened just prior to placing of concrete. Ramos, Director of Parks, Recreation & Community Servs. Subject APPEAL OF REQUIREMENT FOR FENCE AT ANNE SHIRRELLS Date September 24, 1987 PARK Approved Date The Environmental Review Committee has established a requirement that a fence be constructed on two sides of the little league ballfield proposed for Anne Shirrells Park. The purpose of the fence is to prevent street side parking for users of the ballfield. The fencing is supplemental to the standard fencing required for ball- field use and does not serve any other purpose other than to discourage street side parking. This memo is to serve as a formal appeal of this requirement and to request an opportunity to address the Planning Commission on this matter. The reason for this appeal is based on the follo~ing: \ 1. Fence construction is incompatable with the standard "open park" design utilized in this city and consequently would make this park inconsistent with other parks in San Bernardino. 2. Fence construction would create dysfunctional and unsightly "corridors". 3. Fence construction would create an accessibility problem for emergency vehicles. 4. Fence construction would not prevent street parking due to a driveway at one end of the fence which ~uld still provide access for cars parked on the street. \)) 5. Construction of the fence is a "year-round" solution to a seasonal concern. Youth league usage is from April through June and/consequently, overflow parking would occur only at the time. -\\".'\~~: 6. Due to the orientation of the neighboring residenc\es, street side parking should not be an issue. Please advise this department when the appeal hearing will be scheduled.
