STAFF REPORT
Bids for this project were opened at 2:00 p.m., on Tuesday,
11-03-87.
A total of 5 bids were received, ranging from $17,500.00 to
$30,651.00. The low bid price of $17,500.00 is exactly the Engi-
neer's Estimate.
Listed below is an estimate of the total project cost,
based upon the actual low bid price.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
TO GOSNEY CONSTRUCTION FOR CONSTRUCTION OF FILL-IN
ON MT. VERNON AVENUE, FROM UNION STREET TO 21ST STREET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Gosney Construction is the lowest responsible
6 bidder for: Construction of Fill-In Sidewalk on Mt. Vernon Avenue,
7 from Union Street to 21st Street, in accordance with Plan No. 7214,
8 for the total amount of $17,500.00, a contract is awarded to said
9 bidder accordingly, but such award shall be effective only upon
10
the contract being fully executed by the parties; all other bids
11
therefor are hereby rejected; and the Mayor is hereby authorized
12 and directed to execute said contract on behalf of the City; a
13 copy of the contract is attached hereto, marked Exhi bit "A" a'nd
14 incorporated herein by reference as fully as though set forth at
15 length.

SECTION 2. Execution and Amendments. This contract and
17
any amendments or modifications thereto shall not take effect or
18 become operative until fully signed and executed by the parties
19 and no party shall be obligated hereunder until the time of such
20 full execution. No oral agreements, amendments, modifications
21 or waivers are intended or authorized and shall not be implied
22 from any act or course of conduct of any party,
23
SECTION 3. Allor a portion of the funds to be expended
24 in the construction of the project are provided by the United
25 States Department of Housing and Urban Development (HUD). This
26 contract and any amendments or modifications thereto shall not
27 take effect or become operative until fully signed and executed
28 by the parties in the manner required by the applicable HUD
