Synopsis of Previous Council action:
10-5-87
Your Honorable 80dy adopted Resolution of Intention No.87-362, which
sets a public hearing date of November 2, 1987 for the proposed
vacation of State Street, North of Sheridan Road per attached Plan No.
7271.

The hearing was closed and the Findings of Fact as set forth in the
Staff Report from the Director of Public Works/City Engineer dated
October 14, 1987 as to why that portion of State Street, North'
of Sheridan Road is no longer necessary for street purposed was
adopted.
Recommended motion:
Adopt the Resolution.

STAFF REPORT
Upon recelvlng a request from 100% of the adjoining owners to vacate State Street, /'
North of Sheridan Road, and after notification of all interested City Department Heads
and Utility Companies, your Honorable Body approved the attached Plan No. 7271 and
authorized this office to proceed on October 5, 1987.
On the same date, the Resolution of Intention,which contains the reservation of an
easement for sanitary sewer and appurtenant facilities, a Public Utility easements and
and easement for egress and ingress for Lot 4 of Tract No. 12674, was approved. As
required by law, the portion proposed for vacation was posted by this office on
October 14, 1987 and the Resolution was published on the same date.
On November 2, 1987 a protest hearing on the Resolution of Intention was held, the
hearing was closed and the Findings of Fact as set forth in the Staff Report from the
Director of Public Works/City Engineer dated October 14, 1987 as to why that portion
of State Street, North of Sheridan Road is no longer necessary for street purposes was
adopted.
No special requirements have been placed upon the proponents relative to the
proceedings which would require an inspection of the area prior to the adoption of the
Resolution Ordering Vacation. Therefore, we have attached the said Resolution Ordering
Vacation for your action.

A RESOLUTION OF THE CITY OF SAN BERNARDINO VACATING STATE STREET,
NORTH OF SHERIDAN ROAD IN THE CITY OF SAN BERNAROINO AND RESERVING AN
EASEMENT FOR SANITARY SEWER AND APPURTENANT FACILITIES, A PUBLIC UTILITY
EASEMENT AND AND EASEMENT FOR EGRESS AND INGRESS FOR LOT 4 OF TRACT NO.
12674 THERE I N.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1: The Mayor and Common Council of the City of San
Bernardi no, havi ng heard the evi dence offered in re 1 a ti on to the proposed
vacation of State Street, North of Sheridan Road, more particularly
described in Ci ty Resolution of Intention No. B7-362, hereby find from all
of the evidence submi tted that such street proposed to be vacated by said
Resolution is unnecessary for present or pr~spective street purposes.
SECTION 2. The Mayor and Common Council of said City do l\ereby
vacate State Street, North of Sheridan Road, San Bernardino, California,
more particularly described as follows:
That portion of State Street, as delineated on map of
Tract No. 12674, as recorded in Book 183 of Maps, pages
35-37, records of the County Recorder of San Bernardi no
County, State of California, lying northerly of the
southwesterly prolongation of the southerly line of Lot 5
of said Tract, said line also being the northerly line of
Sheridan Road, 60 feet wide.
And is also described in said Resolution No. 87-362.
SECTION 3. This Resolution shall reserve, and nothing herein
shall in any way affect or disturb each and every existing easement for
,sanitary sewer and appurtenant facilities and for public utility purposes
be 1 ongi ng ei ther to the Ci ty of San Bernardi no or to any pub 1 i c util i ty and
there is further reserved for present and future general public utility
purposes and for this City an easement reasonably necessary to locate
sanitary sewer, public utility and appurtenant facilities over, in, under or
across the real property described hereinbefore along with the right to use,

install, maintain, repair, replace or renew such facilities
and an easement for egress and ingress for Lot 4 of Tract No. 12674, and
those reserved by Resolution of Intention No. B7-362.
SECTION 4. The City Clerk of the City of San Bernardino shall
cause a certified copy of this resolution to be recorded in the office of
the County Recorder of the County of San Bernardino.
I HEREBY CERTIFY that the foregoing resolution was duly adopted by
the Mayor and Common Council of the City of San Bernardino at a
meeting thereof held on the
