Synopsis of Previous Council action:
09-08-87 Resolution No. 87-314 adopted authorizing execution of
Utilities Agreement No. 8384 with State.
09-08-87 Finding made that relocation of sewers is needed for
health and safety reasons.
09-21-87 Plans approved and authorization granted to advertise
for bids.
Recommended motion:
Adopt resolution.

STAFF REPORT
Bids for this project were opened at 2:00 p.m. on Tuesday,
10-20-87.
A total of 4 bids were received, ranging from $422,859.00
to $468,322.00. The low bid of $422,859.00 is 3.7% over the Engi-
neer's Estimate of $407,958.00.
The bid from Changing Times Enterprises contained an error
in the extension, which raised it from an apparent low price of
$414,474 to $429,530.
Listed below is an estimate of the total project cost,
based upon the actual low bid price:
Construction Contract $ 422,859
Engr. & Inspection (W.O. #1784) 12,500
Sub-Total $ 435,359
Contingencies (15%)i 65,641
TOTAL ESTIMATED PROJECT COST $ 501,000
All expenditures made for this project will be charged
to Account No. 245-365-57725. Caltrans will reimburse the City ~
for all costs incurred, as provided by Utilities Agreement No.
8394.
We recommend that a contract be awarded to the low bidder.

Paragraph V, of Utilities Agreement No. 8384, states:
"At the election of owner, progress bills for costs
incurred may be submitted. . . where the costs are
sufficient to warrant such billing."
We will, therefore, submit monthly billin~s, based upon our
progress payments to the contractor.
However, Paragraph IV provides that the State will make payment
within 90 days after receipt of an itemized bill.
Please advise if you have any further questions.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO BONADIMAN-McCAIN, INC. FOR RELOCATION OF SEWER
3 FACILITIES FOR CONSTRUCTION OF ROUTE 30, FROM HIGHLAND AVENUE
TO "H" STREET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Bonadiman-McCain, Inc. is the lowest
7 responsible bidder for: Relocation of Sewer Facilities for
8 Construction of Route 30, from Highland Avenue to "H" Street,
9 in accordance with Plan No. 7116, for the total amount of
10 $422,859.00, a contract is awarded to said bidder accordingly,
11 but such award shall be effective only upon the contract being
12 fully executed by the parties; all other bids therefor are
13 hereby rejected; and the Mayor is hereby authorized and directed
14 to execute said contract on behalf of the City; a copy of the
15 contract is attached hereto, marked Exhibit "A" and incorporated
16 herein by reference as fully as though set forth at length.

SECTION 2. Execution and Amendments. This contract and
18 any amendments or modifications thereto shall not take effect or
19 become operative until fully signed and executed by the parties
20 and no party shall be obligated hereunder until the time of such
21 full execution. No oral agreements, amendments, modifications
22 or waivers are intended or authorized and shall not be implied
23 from any act or course of conduct of any party.
