to $396,780.80. The low bid of $289,257.00 is 1.7% over the
Engineer's Estimate of $284,480.00.

Costs incurred for construction of storm drainage facili-
ties at College Avenue will be financed from the $255,000 allo-
cated under Account No. 248-368-57816, for installation of the
master plan storm drain in University Parkway at Route 1-215. The
funds used from this account will have to be replaced whenever
the storm drain at the freeway is done.
An amount of $106,893 has been allocated, to Account No.
242-362-57376, in order to finance the costs for installation of
traffic signals.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO DONALD C. HUBBS, dba JESSE HUBBS AND SONS, FOR
3 INSTALLATION OF TRAFFIC SIGNALS ON UNIVERSITY PARKWAY AT COLLEGE
AVENUE AND HALLMARK PARKWAY.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Donald C. Hubbs, dba Jesse Hubbs and Sons,
7 is the lowest responsible bidder for: Installation of Traffic
8 Signals on University Parkway, at College Avenue and Hallmark
9 Parkway, in accordance with Plan No. 7246, for the total amount
10 of $289,257.00, a contract for Bid Schedules I & II is awarded to
11 said bidder accordingly, but such award shall be effective only
12 upon the contract being fully executed by the parties; all other
13 bids therefor are hereby rejected; and the Mayor is hereby
14 authorized and directed to execute said contract on behalf of
15 the City; a copy of the contract is attached hereto, marked
16 Exhibit "A" and incorporated herein by reference as fully as
17 though set forth at length.

SECTION 2. Execution and Amendments. This contract and
19 any amendments or modifications thereto shall not take effect or
20 become operative until fully signed and executed by the parties
21 and no party shall be obligated hereunder until the time of such
22 full execution. No oral agreements, amendments, modifications
23 or waivers are intended or authorized and shall not be implied
24 from any act or course of conduct of any party.

26 adopted by the Mayor and Common Council of the City of San
