Synopsis of Previous Council action:
On January 22, 1987 the Environmental Review Committee recommended
adoption of a Finding of No Significant Impact (FONSI) under NEPA
for Fiscalini Field.
On February 16, 1987 the Mayor and Council adopted the FONSI.
On September 21, 1987, when considering Public Health and Safety
Findings for replacement of lighting at the ballfield, the Mayor
and Common Council directed that an EIR be prepared addressing
lighting, noise, traffic and parking.
Recommended motion:
That the Council:
1. Direct staff to prepare an Environmental Assessment on the
implementation and operation of Fiscalini Field; and
2. Authorize up to $5,000 for the preparation of technical
studies to comprise an Environmental A,sessm nt.

Subject: Fiscalini Field
Mayor and Council Meeting of October 5, 1987
BACKGROUND
On January 22, 1987 the Environmental Review Committee (ERC)
reviewed the proposed improvements to Fiscalini Field,
including the removal of the existing light fixtures and
towers and the installation of new fixtures and poles includ-
ing conduit for the ballfield, replacement of the existing
bleachers and addition of 1,500 new seats, repaving and
striping of the parking lot, replacement of street lights,
construction of a clubhouse, and installation of retaining
walls by the bleachers. This project is subject to both the
California Environmental Quality Act (CEQA) and the National
Environmental Protection Act (NEPA) because of the use of
federal funds for part of the improvements.
The ERC recommended a Finding of No Significant Impact (or
FONSI) under the NEPA regulations based on the attached
Environmental Assessment (Attachment C). (CEQA recommends
using the NEPA process for projects which must comply with
both CEQA and NEPA.) The Mayor and Council adopted the FONSI
on February 16, 1987, after a ten day public review period.
Subsequently, improvements were made to the ballfield and one
season of operation has passed. During that time a number of
problems surfaced including noise, traffic and parking.
There has been a considerable amount of public concern
expressed to the City Council over the impacts of the ball
park on the surrounding neighborhood.
On September 21, 1987, during a discussion of Public Health
and Safety Findings required by the OPR for the replacement
of the lighting fixtures, the Council directed staff to cause
to be prepared an Environmental Impact Report which addresses
lighting, noise and traffic.
~B~_ENYIRON~~~~~_~~YIEW PROCESS
The environmental review process (both NEPA and CEQA) is a
disclosure process intended to assure that the public and the
decision makers are fully aware of the impacts that will
occur if a project is approved. Also, it is intended to
provide sufficient information on what kinds of changes or
mitigation measures can be made in the project to reduce or
remove those impacts.
The process prescribed by the Public Resources Code would be
to prepare an Initial Study (an Environmental Assessment

under NEPA) of the project considering all phases of project
planning, implementation, and operation. Based on the
information provided by the Initial Study regarding the
impacts of the project and the measures which could be
applied to mitigate negative impacts, a Determination of
Significance is made. An EIR (or EIS under NEPA) would be
required under the state law if the lead agency determines
from the Initial Study that there is substan~ial evidence
that a project may have a significant effect on the environ-
ment.
Section 15064 of the CEQA Guidelines calls for careful
judgment on the part of the public agency and the decision
must be based to the extent possible on the scientific and
factual data provided in the Initial Study. Section 15064(h)
indicates that in marginal cases the lead agency should be
guided by the following factors: 1) an EIR should be
required if there is serious public controversy over the
environmental effects (however, controversy unrelated to
environmental issues does not require preparation of an EIR),
and 2) an EIR should be required if there is a disagreement
between experts over the significance of the effect on the
environment.
If the Initial Study which examines in detail the potential
impacts of the project, finds that they can be substantially
mitigated or removed, the project does not need and EIR (or
EIS). Instead, the City would process a Negative Declaration
(or FONSI) and impose the mitigation measures required.
It is important to remember that the Mitigation Measures
identified in either an Initial Study or an EIR are not auto-
matically applied to a project. Certification of the EIR or
adoption of the Negative Declaration does not implement the
mitigation measures. They must be adopted as conditions of
approval or be incorporated into the redesign of the project.
Inclusion in the environmental document alone is not ade-
quate, since it is only an information document.

From a technical standpoint, it is the Planning Department's
opinion that an EIR/EIS is not necessary for Fiscalini Field
in order to obtain sufficient information to mitigate the
current problems. We believe the appropriate approach would
be to prepare an Environmental Assessment under NEPA which
addresses the lights, noise, parking, and traffic. This
study would provide adequate information in the form of
mitigation measures to reasonably reduce or remove the
negative impacts. This was discussed with the ERC on
September 24, 1987 and the ERC concurred.

The major difference between any EIR/EIS and an Initial
Study/Environmental Assessment ~s that the EIR would be
required to assess additional options, including a "no
project" option and a "worst case scenario" plus other
alternatives. The term "focused EIR" is misleading in that
all EIRs and Initial Studies are "focused" on the identified
potential impacts of the project itself and do not cover the
entire spectrum of possible impacts. For example, for a
project downtown in an area that has been built out for
years, it is not necessary to study flora and fauna or
archaeological sites. The document studies only those
impacts which the project has the potential of causing.
However, the potential of legal challenge is also a consider-
ation the Mayor and Council should address in deciding which
environmental document to prepare.
THE SCOPE OF ~HE DOCUMENT
Whichever document is prepared, the environmental work must
focus on the scope of the project. In this case, the project
should be the entire ballfield improvement program and
operation, not just the lights, although that was the item
which precipitated the Council action.
The replacement of the lights, by itself, is an exempt
project and would not be subject to CEQA or NEPA.
The potential impacts of the project have been identified as
lighting, noise, traffic and parking.

Discussions with the Engineering Division and the manu-
facturer of the proposed lights lead staff to believe that
City staff, with the assistance of Southern California Edison
and the manufacturer, can measure the lights and develop the
readouts required to assess the impacts of the proposed
lights. Planning staff would prepare an analysis of the
impacts using the measurements taken by the Engineering staff
(using light meters from Southern California Edison) and
readouts of the proposed lighting prepared by the manu-
facturer. This would incur only staff time and would be
sufficient for the purposes of an Initial Study/Environmental
Assessment.
However, the alternatives which would have to be studied in
an EIR/EIS would require preparation of projections for
various alternatives, and would not be within the capabili-

ties of staff to prepare or the manufacturer to provide at no
cost. A rough estimate of the cost for this analysis is
$2,000 to $3,000.
Noise
Currently, a noise study is being prepared for the Parks,
Recreation and Community Services Department by an outside
consultant and has been substantially completed. The cost of
the study is $13,000 (the source has not been identified) and
the study will assess the current noise impacts and provide
mitigation measures. No additional work would be required,
for the Initial Study/Environmental Assessment.

The Engineering Division of the Public Works Department
estimates that an analysis of the existing conditions includ-
ing street capacity of Highland Avenue from Del Rosa Avenue
to Waterman Avenue, intersection analysis, and on-site
circulation and parking would cost $5,000. This study would
have to be prepared by an outside consultant in that the
Public Works Department at this time does not have the
ability to conduct these studies.
If the additional alternatives required for an EIR/EIS are
included, the cost would be an estimated $10,000.
OPTIONS
There are two major decisions which the Council must make:
1. What will be the source of the funds for the remaining
improvements to the ballfield, including the lights? If
the choice is to use federal money, environmental
documentation must be prepared pursuant to NEPA.
2. What type of environmental study is appropriate? If the
Council wishes to address the existing problems only,
the study of the existing scenario is appropriate.
However, if the Council feels that, pursuant to Section
15064 of the State Guidelines, there there is serious
public controversy over environmental issues, the more
intensive study (EIR/EIS) is appropriate.

The attached chart indicates the various options and the time
and cost implications of each. Staff time has been noted but
not costed out. Timing is based on working days and the
major variables are the time it takes to complete the techni-
cal studies and the mandatory public review periods.

Summary of Environmental Conditions, Findings and Conclusions and Mitigation
Measures.
Traffic and Circulation
The ratio of seats to parking spaces is approximately 9 persons per parking
space. The dirt lot to the south of the parking lot can be used for additional
parking, however, this creates dust and access concerns. It is recommended
that the dirt lot be paved and striped to provide adequate parking and unrestict-
ed circulation.
Noise
It is recommended that noise levels be measured during a game to determine if
mitigation measures are necessary.
Compatibility
The improvements to the ball park are consistent with its existing use and the
General Plan and zoning. The surrounding uses to the east and north are com-
mercial and to the west and south are other park facilities. Housing a pro-
ball team at Fiscalini Field brings a recreational amenity to the City of San
Bernardino.
Environmental Hazards
There are no ha2ards at present such as those associated with slope, erosion,
toxics, flooding and drainage. The improvements to the ball field will not
create any potential hazards. Minimal grading will be required which will
not include Perris 8111 itself.
Services
The City provides services such as water, sewer, trash pick up, police and fire.
The potential intensification of use can be provided for and these services will
not be impacted.
Security
The ballfield and clubhouse will have an alarm system installed. The ball team
will be responsible for providing security during the games.
