August 8, 1977 - License agreement executed with Donald R. Mittica for use of pro shops
at Perris Hill and Blair Parks for a period of three years.
July 22, 1980 - Li cense agreement of August 8, 1977 is amended to extend the agreement
for three years.
August 1, 1983 - License agreement is amended to extend it for five years.

RESOLUTION CANCELLING AGREEMENT WITH
DONALD R. METTICA FOR USE AND OPERATION~AFF REPORT
OF TENNIS PROSHOPS AT PERRIS HILL PARK
AND BLAIR PARK.
Donald R. Mittica has been the sole user and operator of the tennis pro
shops at Perris Hill Park and Blair Park since August, 1977. He has in-
dicatedto this department that he is desirious of retiring as a tennis
professional and has asked to be relieved of his contract effective
October 1, 1987.
This department concurs with Mr. Mittica's request and recommends approval.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING EXECUTION OF Atl
AGREEMENT TERtlINATING THE AGREEMENT FOR THE USE AND OPERATION. OF TENNIS PRO
SHOPS AT PERRIS HILL PARK AND BLAIR PARK.
BE IT RESOLVED BY THE t4AYOR AND COI1MON COUNCIL OF THE CITY Of SAN
BERNARDINO AS FOLLOWS:
SECTION 1. Recitals,
A. By agreement dated August 10, 1977, by and between the City of San
Bernardino and Donald R. Mittica, the parties entered into an agreement relating
to use and operation of Tennis Pro shops at Perris Hill Pal'k and Blair Park.
This contract was amended and extended in July of 1980 for 3 years and in August
of 1983 for 5 years. This contract is due to expire on August 10, 1988,
B. The parties mutually agree that cancellation of the agreement effective
October 1, 1987, is in the best interest of the parties,
SECTION 2, .!!!!2.lementation. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of the City of San
Bernardino an agreement terminating the agreement between the City of San
Bernardino and Donald R. Mittica, attached hereto as Exhibit A and incorporated
herein by reference, effective October 1, 1987.

RELATING TO USE AND OPERATION OF TENNIS PRO SHOPS AT PERRIS HILL PARK AND
BLAIR PARK,
)
In accordance with the provision of California Civil Code Section 1699,
the parties to the agreement dated August 10, 1977, pertaining to the use and
operation of Tennis Pro Shops at Perris Hill Park and Blair Park, hereby
intend to, and do, terminate that agreement by cancellation effective
October I, 1987.
