STAFF REPORT
Upon recelvlng a request from 33% of the adjoining owners to vacate a
portion of 17th Street, East of Conejo Drive, and after notification of
all interested City Department Heads and Utility Companies, your
Honorable Body approved the attached Plan No. 7074 and authorized this
offi ce to proceed on April 20, 1987.
On the same date the Resolution of Intention, which contains the
reservation of an easement for Public Utilities and an easement for
ingress and egress to the County of San Bernardino to serve the Flood
Control Channel and bridge to the East, and for the Ci ty of San
Bernardino Emergency vehicles and serving utility company vehicles, and
abutting property owners thereof, was approved. As required bylaw, the
portion proposed for vacation was posted by this office on April 29,
1987, and the Resolution was published on the same date.
In the opinion of this Division, there is no further necessity for a
porti on of 17th Street, East of Conejo Dri ve, ei ther for present or
prospective street purposes. Therefore, we recommend the vacation on
the basis of the following Findings of Fact:
1. The above portion of the street has been determined by the
Department of Public Works to be of no further necessity to the
genera 1 publ i c.
2. 33% of the adjoining property owners have requested the proceedings
and t~e required $400.00 fee has been paid.
3. 8y virtue of the posting and publication of the proposal, neither
this office nor the City Clerk's Office has received any written
protests against the vacation as of this date.
4. The fact that easements have been reserved in the area to be vacated
does not indicate the necessity for general public use of the area
in question.
No special requirements have been placed upon the proponents relative to
the proceedings which would require an inspection of the area prior to
the adoption of the Resolution Ordering. Therefore, we have attached
the said Resolution Ordering the vacation for your action.

,A RESOLUTION OF THE CITY OF SAN B~~NARDINO VACATING A
3 PORTION OF 17TH STREET. EAST OF CONEJO DRIVE. IN THE CITY OF
SAN BERNARDINO AND RESERV ING PUBLIC UTILITY EASEMENTS. AND AN
4 EASEMENT FOR INGRESS AND EGRESS TO THE COUNTY OF SAN BERNARDINO
TO SERVE THE FLOOD CONTROL CHANNEL AND BRIDGE TO THE EAST. AND
5 FOR THE CITY OF SAN BERNARDINO EMERGENCY VEHICLES AND SERVING
UTILITY COMPANY VEHICLES AND ABUTTING PROPERTY OWNERS THEREOF.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
7 CITY OF SAN BERNARDINO AS FOLLOWS:
8 SECTION 1: The Mayor and Common Council of the City of
9 San Bernardino. having heard the evidence offered in relation
10 to the vacation of a portion of 17th Street. East of Conejo
11 Drive. more particularly described in Ci ty Resol ution of
12 Intention No. 87-128. hereby find from all of the evidence
13 submitted that such street proposed to be vacated by said
14 Resolution is unnecessary for present or prospective street
15 purposes.

SECT ION 2. The Mayor and Common Council of sa i d Ci ty do
hereby vacate a portion of 17th Street. East of Conejo 'Drive.
San Bernardino. California. more particula~ly described as
follows:
The South 15.00 feet of Lot 10. Tract No. 2316 as per
plat recorded in Book 33 of Maps. page 31. records of
the County Recorder of San Bernardino County. State
of California.
And is also described in said Resolution No. 87-128.
SECTION 3. This Resolution shall reserve. and nothing
herein shall in any way affect or di sturb each and every
existing easement for public utility purposes belonging either
to the City of San Bernardino or to any public utility. and

to the East. and for the Ci ty of San Bernardino emergency
vehicles and serving utility company vehicles and abutting
property owners thereof. and those reserved by Resolution of
Intention No. 87-128.
SECTION 4. The City Clerk of the City of San Bernar~ino
shall cause a certified copy of this Resolution to be recorded
in the office of the County Recorder of the County of San
Bernardino.

Dear Neighbors:
,Pursuant to our meeting April 6, 1987 and telephone conversation
April 14, 19871 the above-referenced Letter Agreement is hereby
amended as follows:
1. Add Item No. 3,C: A "Private Street - No Parking" sign
will be placed at entrance of easement.
2. Add Item No. 3,D: Construct a 6'0" high concrete block
wall, approximately, along the northerly boundary of the
easement mentioned on 2,D with a- sliding gate for egress
and ingress to the corner house as shown on site plan
dated March 30, 1987 (exact location is subject to
approval by the City of San'Bernardinol.
