STAFF REPORT
BID SPEC: F-B7-35
The proposed purchase is for Street Resurfacing by hot surf&ce recycling. At the
request of the Public Serices/Street Department appropriate specifications were
prepared, published and furnished to area suppliers. The following is a summary
of bids received.

There is only one vendor in Southern California who can do this particular work due
to the specialized equipment required. This information has been verified after
soliciting 72 vendors on Bid F-86-28 & F-87-2.
Specifications as bid have been reviewed with the Director of Public Services who
concurs, that the bid of Payne-Whitney Co. meets specifications and requirements.
It is threfore recommended that the bid be accepted for contract. The amount of
$260,000. was included in the 1986/87 Budget for this project.

The Purchasing Agent suggests in the interest of time. and supporting the Director
of Public Services in reaching his objectives in a timely manner, that the sole
source vendor in the future be negotiated rather than the frivolous and unpro-
ductive bid procedure. Whose outcome is known beforehand.
GENERAL EXCEPTIONS TO BIDDING REQUIREMENTS
Some exceptions have generally been recognized to the competitive bidding
requirements. One is:
ONLY ONE SOURCE AVAILABLE
Where there is no chance of real competitive bidding to require bids and that
would work an incongruity and serve no legitimate purpose such as only one
possible source being available for the product or equipment.

WITH SPECIFICATION NO. F-87-35.

5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:

F-87-35, at a total cost of $105,B77.00; that such bid is satisfactory

and in accordance with Specification No. F-87-35; pursuant to this deter-

mination, the Purchasing Agent is hereby authorized and directed to issue

a purchase order for said street resurfacing to said lowest and best bidder;
13
and such award shall only be effective upon the issuance of a purchase order
by the Purchasing Agnet.
