Council Notes: Aaenda Item No, /I. . CIT9 OF SAN BERNARDI~ - REQUEO FOR COUNCIL AC~N STAFF REPORT Bids were received at 2:00 p.m. on Wednwsday, 4-22-87. A total of 5 bids were received, ranging from $95',137.46 to $160,047.00. The apparent low bid of $95,137.46 is 12.9% over the Engineer's Estimate of $84,300.00. In accordance with the project specifications and requirements for Federal monies, the two apparent low bidders were requested to submit informa- tion on their minority business and women businesses for participation in the goals established on this project. The apparent low bidder was unable to meet the specified percentage of minority business participation and, therefore, failed to meet contract re- quirements. Upon concurrence with Caltrans, the project is recommended for award to the second low bidder who has met the minority goals for the project and did submit all information in correct order. Listed below is the total estimated project cost, based upon the actual second low bid price: Construction Contract $ 103,156.00 Engineering & Inspection (W.O. #1482) $ 13,115.00 Sub- Tota 1 $ 116,271.00 Contingencies (15%1:) $ 17,4,29.00 TOTAL $ 133,700.00 Federal participation is estimated to be 86% of the project total ($114,982). Local agency share will be about 14% ($18,718). An amOunt of $22,593.68 was appropriated in the 85-86 budget, in account Number 242-362-57364, for this project. Caltrans has reviewed the project and the bids and has granted authorization to award a contract to the second lowest bidder. Box 231 San Bernardino, CA. 92403 Attention: Mr. Carl Radsick Re: DB and WBE Information -- Federal-Aid Urban Project M-3069 (23) -- Bus Stop Renovation at 9 Locations Dear Mr. Balcom: Bob Britton Inc. was notified by telephone on April 22,1987, that they were the apparent successful low bidder. We did not have time to notify Bob Britton Inc., by certified letter, since the contract documents state that the low bidder and the second low bidder shall submit DB and WBE information to this office no later than close of business on the first Monday after bid opening. We requested that the required information on DB and WBE's be submitted no later than Monday, April 27,1987. We again called Mr. Britton's office on April 23rd and 24th to offer our assistance in helping them meet the required goals. This information has been reviewed and found to be in order. Based on this information, we have determined that Redlands Paving Inc. is the lowest responsible bidder, and they have met the specified DB and WBE goalS for this project. FOR RENOVATION OF CENTRAL CITY 3 BUS STOPS. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINC AS FOLLOWS: 5 SECTION 1. Redlands Paving, Inc. is the lowest responsible bidder for renovation of Central City Bus Stops, in accordance with Plan No. 7048, for the total amount of $103,156.00, and a contract is awarded to said bidder accordingly, but such award shall be effective only upon the contract being fully executed by the parties; all other bids therefor are hereby rejected; and the Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendments or modifications thereto shall not take effect or become operative until fully signed and executed by the pJrties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party.
