DESCRIPTION) General Fund Finance: ~,~i~ Council Notes: 1 Agenda Item No._ ~ elk OF SAN BERNARDh.O - REQUM FOR COUNCIL ACQoN STAFF REPORT Upon receiving a request from 33% of the adjoining owners to vacate a portion of 17th Street, East of Conejo Drive, and after notification of all interested City Department Heads and Utility Companies, your Honorable 80dy approved the attached Plan No. 7074 and authorized this office to proceed on April 20, 1987. On the same date the Resolution of Intention, which contains the reservation of an easement for Public Utilities and an easement for ingress and egress to the County of San Bernardino to serve the Flood Control Channel and bri dge to the East, and for the Ci ty of San Bernardino Emergency vehicles and serving utility company vehicles, and abutting property owners thereof, was approved. As required by law, the portion proposed for vacation was posted by this office on April 29, 1987, and the Resolution was published on the same date. In the opinion of this Division, there is no further necessity for a portion of 17th Street, East ~f Conejo Drive, either for present or prospective street purposes. Therefore, we recommend the vacation on the basis of the following Findings of Fact: 1. The above portion of the street has been determined by the Department of Publ ic Works to be of no further necessi ty to the general public. 2. 33% of the adjoining property owners have requested the proceedings and the required $400.00 fee has been paid. 3. 8y virtue of the posting and publication of the proposal, neither this office nor the City Clerk's Office has received any written protests against the vacation as of this date. 4. The fact that easements have been reserved in the area to be vacated does not indicate the necessity for general public use of the area in question. No special requirements have beenplace4 upon the proponents relative to the proceedings which would require an inspection of the area prior to the adoption of the Resolution Ordering. A RESOLUTION OF THE CITY OF SAN BERNARDINO VACATING A 3 PORTION OF 17TH STREET, EAST OF CONEJO DRIVE, IN THE CITY OF SAN BERNARDINO AND RESERV ING PUBLIC UTILITY EASEMENTS, AND AN 4 EASEMENT FOR INGRESS ANO EGRESS TO THE COUNTY OF SAN BERNARDINO To SERVE THE FLOOD CONTROL CHANNEL AND BRIDGE TO THE EAST, AND 5 FOR THE CITY OF SAN BERNARDINO EMERGENCY VEHICLES AND SERVING UTILITY COMPANY VEHICLES AND ABUTTING PROPERTY OWNERS THEREOF. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 7 CITY OF SAN BERNARDINO AS FOLLOWS: 8 SECTION 1: The Mayor and Common Council of the City of 9 San Bernardino, having heard the evidence offered in relation 10 to the vacation of a portion of 17th Street, East of Conejo 11 Drive, more particularly described in City Resolution of 12 Intention No. 87-128, hereby find from all of the evidence 13 submi tted that such street proposed to be vacated by said 14 Resol uti on is unnecessary for present or prospecti ve street 15 purposes. 16 SECT ION 2. The Mayor and Common Counci 1 of sai d Ci ty do 17 hereby vacate a portion of 17th Street, East of Conejo Drive, 18 San Bernardino, California, more particularly described as 19 follows: 20 The South 15.00 feet of Lot 10, Tract No. 2316 as per plat recorded in Book 33 of Maps, page 31,records ~f 21 the County Recorder of San Bernardino County, State of Califor.nia. 22 23 24 25 26 27 28 And is also described in said Resolution No. 87-12B. SECTION 3. SECTION 4. The City Clerk of the City of San Bernardino shall cause a certified copy of this Resolution to be recorded in the office of the County Recorder of. the County of San Bernardino.
