STAFF REPORT
Bids for this landscape maintenance project were opened at 2:00 p.m.
on Tuesday, 5-12-87.
A total of 3 bids were received, ranging from $2,100.00 to $2,800.00.
The low bid price of $2,100.00 is 2.1 times higher than the Engineer's Esti-
mate of $1,000.00.
Listed below is an estimate of the
maintenance service from 7-1-87 to 6-30-88,

TOTAL ESTIMATED PROJECT COST
The Notice to Proceed will be effective on July 1, 1987. The con-
tract will be in effect until June 30, 1988. Bids will be solicited for a
new contract commencing July 1, 1988.
Funding for the costs incurred on this project will be provided pur-
suant to Resolution No. 86-321, adopted on August 5, 1986, which orders the
installation and maintenance of the landscaping. The landscaping was installed
under a previous contract. Costs for maintenance will be pre-funded by the
City, as set forth in the Resolution of Intention (Resolution No. 86-263), and
the amount reimbursed through assessments levied on all parcels within the
district for the following fiscal year.
Supervision of the maintenance effort will be provided by the Depart-
ment of Parks, Recreation and Community Services, who has reviewed the bids
and agrees to awarding a contract.
We recommend that a contract be awarded to the low bidder.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO C & 0 LANDSCAPE SERVICE FOR MAINTENANCE OF LANDSCAPING
3 IN PORTIONS OF THE SOUTH SIDE OF RIALTO AVENUE.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. C & D Landscape Service is the lowest
responsible bidder for construction of a public project, to-wit:
Maintenance of Landscaping in portions of the south side of
Rialto Avenue from 256 feet west of the centerline of Pepper
Avenue to a pOint 525 feet east of the centerline of Eucalyptus
Avenue, Assessment District No. 974, in accordance with Plan No.
6998 (1987-88) for the total amount of $2,100.00; a contract is
awarded to said bidder accordingly, but such award shall be
effective only upon the contract being fully executed by the
partie?; all other bids therefor are hereby rejected; and the
Mayor is hereby authorized and directed to execute said contract
on behalf of the City; a copy of the contract is attached hereto,
marked Exhibit "A" and incorporated herein by reference as fully
as though set forth at length.
SECTION 2. This contract and any amendments or
modifications thereto shall not take effect or become operative
until fully signed and executed by the parties and no party shall

be obligated hereunder until the time of such full execution.

No oral agreements, amendments, modifications or waivers are

intended or authorized and shall not be implied from any act
or course of conduct of any party.
