Synopsis of Previous Council action:
05-22-84 -- Resolution No. 84-189 adopted awarding a contract for maintenance of
landscaping in Assessment District No. 951 to Sandahl's Landscape and
Maintenance for the low bid price of $1,450.00.
0-00-85 -- Resolution No. 85 adopted awarding a contract for Maintenance of
Landscaping in Assessment District No. 951 to Sandahl's Landscape and
Maintenance for the low bid price of $1,440.00.
06-02-86 -- Resolution No. 86-232 adopted, awarding a contract for maintenance of
landscaping in A.D. 951 to Mentone Turf Supply for the low bid price
of $2,698.00.

STAFF REPORT
Bids for this project were opened at 2:00 p.m. on Tuesday, 5-12-87.
A total of 4 bids were received, ranging from $3,228.00 to $4,200.00.
The low bid price of $3,228.00 is 17.2% under the Engineer's Estimate of
$3,900.00.
'Listed below is an estimate of the total cost for providing these
landscaping maintenance services, from 7-1-87 to 6-30-88, based upon the
actual low bid price:
Maintenance Contract $ 3,228
Incidental Costs (Assessment Engineering,
Publishing & Recording Fees, Supervision
by Dept. of Parks & Recreation and
Advertising for Bids) $ 1,200
TOTAL ESTIMATED PROJECT COST $ 4,428
The Notice to Proceed will be effective on July 1, 1987. The con-
tract will be in effect until June 30, 1987. Bids will be solicited for
another contract commencing on July 1, 1988.
Funding for the costs incurred on this project will be provided
pursuant to Resolution No. 81-482, adopted on October 5, 1981, which orders
the installation and maintenance of the landscaping. The landscaping was
installed under a previous contract. Costs for maintenance will be pre-
funded by the City, as set forth in the Resolution of ,Intention (No. 81-36),
and the amount reimbursed through assessments levied on all parcels within
the district for the following fiscal year.
Supervision of the maintenance effort by the contractor will be
provided by the Department of Parks, Recreation and Community Services,
who have reviewed the bids and agree to awarding a contract.
We recommend that a contract be awarded to the low bidder.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MENTONE TURF SUPPLY FOR MAINTENANCE OF LANDSCAPING IN
3 PORTIONS OF KENDALL DRIVE (STATE ROUTE 206).
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Mentone Turf Supply is the lowest responsible
bidder for construction of a public project, to-wit: Maintenance
of Landscaping in portions of Kendall Drive (State Route 206),
Assessment District No. 951, in accordance with Plan No. 6192-A
(1987-88), for the total amount of $3,228.00, a contract is
awarded to said bidder accordingly, but such award shall be
effective only upon the contract being fully executed by the
parties; all other bids therefor are hereby rejected; and the
Mayor is hereby authorized and directed to execute said contract
on behalf of the City; a copy of the contract is attached hereto,
marked Exhibit "A" and incorporated herein by reference as fully
as though set forth at length.
SECTION 2. This contract and any amendments or
modifications thereto shall not take effect or become operative
until fully signed and executed by the parties and no party shall
be obl igated hereunder until the time of such full execution.
No oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
