RE~OLUTION OF THE ClTY OF SAN BERNARDINO ADOPTING STP.lIDARD REQUIREMENT NO. 11 RELATING TO UNDERGROUNDING UTILITY LINES. BE IT RESOLVED BY THE ~~YOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Purs~ant to San Bernardino Municipal Code Section 18.44.070, the following requirement for undergrounding utility lines is hereby adopted: "StandarC: Requirement No. 11 11. All existing overhead utility lines, including, but not limited to electrical, telephone, cable television, and street light service, shall be placed underground. This requirement shall apply to all such lines traversing the development, or installed along either side of streets adjoining the development, except for electrical transmission lines of 33 KVA and above; distribution lines of 33 KVA and below shall be undergrounded. Where one line is exempt, all lines on that pole shall be exempt. Arrangements, incluC:ing payment of costs, shall be made by the developer with the serving utility cornpany(s). Undergrounding of utility structures may be done by the developer, with per~ission from the serving utility. For developments with small frontages, the Director of Public Works/City Engineer may accept a cash payment from the developer, in lieu of undergrounding the lines. Payments will be baseC: upon a written estimate of the short form unit cost from the serving utility COLtpany (s), and will reflect the development's proportionate share of the estimated cost for 5/4/87 -1- o J ) undergrounding the lines over the entire section. In the event that property on the opposite side of the street is vacant, the developer shall pay fifty percent of the estimated cost of undergrounding. When the vacant property is developed it will pay the remaining fifty percent of the cost of undergrounding. The cost of undergrounding shall be calculated to exclude the cost of street crossings; the entire cost to underground street crossing lines shall be borne by the property served by the crossing lines. All payments will be deposited into a line item account for undergrounding utilities within the area. In no event shall the payments from developers on both sides of the street exceed the total estimated cost for undergrounding utilities along that section of street. Standard Requirement No. 11 shall not apply to the remodeling of existing buildings where the cost of remodeling is less than 50% of the replacement cost of the existing structure. Standard Requirement No. 11 shall apply to any project for which a building permit has not been issueu. An appeal from this requirement may be subRitted to the Mayor and Common Council pursuant to San Bernardino r~unicipal Code Section 18.44.070 Subsection N."
