MEMO RAN DUM OF' UNDERST ANDING PART IES Parties to this agreement are the Department of Mental Health (Department), Patton State Hospital (Hospital), East Valley Water District (District), City of San Bernardino (City), and the County of San Bernardino (County). PURPOSE In order to enhance the relationship between Patton State Hospital and ~he surrouoding communities of Highland and San Bernardino, the parties to this agreement intend to cooperate in the development, maintenance, and operation of a neighborhood park to be 10cated on property owned by the State of California and presently under the administrative control of the Department and Hospital. The parties a~ree that the responsibilities herein designated and the time frames established are reasonable and necessary for the timely and satisfactory accomplishment of this objective. AG llEEMENT It is agreed that: Prior to Julv 1987 the Department and the Hospital shall conduct a feasibility study and assessment for a neighborhood park to be located on a minimum of the North Easternmost 10 acres of the Hospital grounds. This assessment shall include a determination of those park facilities needed relative to the appropriateness of the site. Based on this study, the Department shall provide a prelimi- nary pIan for the facility, to be approved by the parties to this agreement. Not later than October 1987, the Department and the Hospital shall provide working drawings for a park facility satis- factory to the parties. Upon acceptance of the plans by all parties hereto, the Department shall execute a lease for the maximum term allowable by law to the City, County and District. Terms of this lease shall include rights and responsibilities of the parties for development and maintenance of the leased area, as determined to be reasonably necessary by the parties. c. "'"" v o :) Suh.i,,~t to the availability of funds it is the intent of the Deoartment and Hospital, that the construction of the proposed park is to begin no later than July 1, 1988. It is understood by the parties, that the Department and the Hospital have the primary responsibility for development of the park, in accordance with the final plans, as aoproved by the parties. It is agreed that the District shall provide, at no cost to the other parties to this agreement, both irrigation and domestic water necessary for development. maintenance and operation of this park, during the term of the lease. During the term of the lease, the Department and Hospital will continue to provide security patrol services to the area encom- passed by the proposed park. It is the intent of the parties to this agreement that the City and County shall jointly or severally maintain and operate this park, with the exceptions as noted. The parties to this agreement recognize and agree that the accomplishment of the purposes and objectives under this agreement are subject to compliance with applicable requirements of law and to obtaining applicab1e approvals from control agencies at both the state and local levels. In the event that legislative authority is necessarv for any portion of this project, the State Department of Mental Health agrees to make its best efforts to obtain such legislative authoritv. AGREEMENT IT IS HEREBY AGREED, that: 1. The East Valley Water District will provide up to 60 acre feet of water per year for irrigation of the proponed park at no cost to the State of California. 2. East Valley Water District will be paid for water usage in excess of 60 acre feet per year at the rate charged other customers of the District at that time. 3. This agrement, unless extended, will terminate in twenty five (25) years from the date this amendment is finally executed by all parties.
