box cui vert on Mission Creek at Tippecanoe Avenue.
10/07/85 -- Adoption of Resolution for the execution of Cooperative Agreement
between the City and the County for the widening of the box culvert
(50% cost sharing - City as lead agency).
03/03/86 Adopt Resolution 86-88 authorizing agreement for professional services
for design of box cuivert.
06/02/86 Adopt Resolution 86-217 authorizing agreement with County of San 8ernardino
for instailation of automatic gates at Railroad Crossing 2U-4.2.
01/19/87 Plans approved and authorization granted to advertise for bids.

STAFF REPORT
Bids for the improvement of the Mission Creek Box Culvert at Tippecanoe
Avenue were opened at 2:00 p.m. on Tuesday, 5-19-87.
A total of 2 bids were received, in the amounts of $231,880.00 and
$256,669.00. The low bid of $231,880.00 is 25.1% over the Engineer's Esti-
mate of $185,300.00.
Listed below is an estimate of the total project cost, based upon the
actual low bid price:

About 9 general contractors took out plans and speciai provisions for
this project. However, only 2 actuaily submitted bids. We have contacted
some of the contractors to determine why they did not submit a bid. The pre-
vailing reason was that they are simpiy too busy with other projects.
After reviewing the bids with the low bidder, we believe that the
low bid represents the best price we can reasonably expect to receive.
One half of all costs incurred wili be borne by the County, under
terms of our cooperative agreement. Mr. John Steger, Chief - Transportation
Program Management, has reviewed the bids and recommends that a contract be
awarded.
A total amount of $97,100 has been allocated from City funds, under
Account No. 242-362-57363, to finance the City's share of improving the box
culvert and adjacent grade crossing. The estimated City's share of the
grade crossing improvement is $19,310, which leaves $77,790 available for the
box culvert.
Supplemental funds in the amount of $61,910 will be needed to fully
finance the City's share of the box culvert improvement. It is proposed that
the supplemental funds be provided in the 1987-88 Street Construction Fund
Budget.
We recommend that a contract be awarded to the low bidder.
Work is scheduled to be started by the Santa Fe Railway Company in
October, 1987, on widening and instaliing additional crossing protection for
the adjacent grade crossing.

FOR IMPROVEMENT OF TIPPECANOE

4 BE IT RESOLVED 8Y THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN 8ERNARDINO AS FOLLOWS:

SECTION 1. Bonadiman-McCain, Inc. is the lowest
6
responsible bidder for the improvement of Tippecanoe Avenue at
7 Mission Creek~ in accordance with Plan No. 7098, for the total
8 amount of $231,880.00, and a contract is awarded to said bidder
9 accordingly, but such award shall be effective only upon the
10 contract being fuliy executed by the parties; all other bids
11 therefor are hereby rejected; and the Mayor is hereby authorized
12 and directed to execute said contract on behalf of the City; a
13 copy of the contract is attached hereto, marked Exhibit "A" and
14 incorporated herein by reference as fully as though set forth at
15 length.

SECTION 2. This contract and any amendments or
17 modifications thereto shail not take effect or become operative
18 until fully signed and executed by the parties and no party shall
19 be obligated hereunder until the time of such full execution. No
20 oral agreements, amendments, modifications or waivers are intended
21 or authorized and shall not be implied from any act or course of
22 conduct of any party.
