STAFF REPORT
Funds have been made available, under the Federal Bridge Replacement
Program, to finance 80% of the project cost. The remaining 20% will have to
be provided from City funds.
Execution of Program Supplement No. 45, to Local Agency-State Agreement
for Federal-Aid Projects No. 08-5033, will commit $151,200 of Federal-Aid Funds
for this project.
An amount of $30,100 has been allocated, under Account No. 242-362-
57373, Valley Street at Warm Creek, to finance the local agency share.
It is required that Program Supplement No. 45 be executed by the City
and State, in order to receive Federal-Aid funds for this project. Therefore,
we recommend that authorization to execute this supplement be granted.

SAN 8ERNARDINO AUTHORIZING THE EXECUTION OF PROGRAM SUPPLEMENT NO.
3 45 TO LOCAL AGENCY-STATE AGREEMENT FOR FEDERAL-~ID PROJECTS NO.
8-5033 BETWEEN SAID CITY AND THE STATE OF CALIFORNIA, ACTING BY
4 AND THROUGH ITS DEPARTMENT OF TRANSPORTATION.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said
City Program Supplement No. 45 to Local Agency-State Agreement
for Federal-Aid Projects No. 8-5033 to authorize certain safety
improvements, between said City and the State of California,
acting by and through its Department of Transportation, a copy
of which is attached hereto marked Exhibit "A" and incorporated
herein by reference as fully a~'though set forth at length
herein.

SPECIAL COVENANTS OR REMARKS
1. All maintenance, involving the physical condition and the
operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will be
performed by the Local Agency at regular intervals or as
required for efficient operation of the completed improvements.
2. In executing this Program Supplemental Agreement the Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal-Aid Programs.
3. The Local Agency will advertise, award, and administer this
project and will obtain the State's concurrence prior to
either award or rejection of the contract.
4. The Local Agency agrees the payment of Federal funds will be
limited to the Detail Estimate amounts approved by the
Federal Highway Administration in the Federal-Aid Project
Agreement (PR-2J, or its modification (PR-2AJ, and accepts
any increases in Local Agency Funds as shown on the Finance
or Bid Letter or its modification as prepared by the Division
od Local Streets and Roads.
