STAFF REPORT
Submitted for your consideration and approval is a Memorandum of Agreement between
the Agency and the Community Development Department providing for payment to the
Agency of costs incurred under specified Employment Linkage Agreements outside of
Redevelopment project areas.
BACKGROUND
On Monday, October 20, 1986, the Community Development Commission approved
Resolutions 4944 and 4945 authorizing the execution of Employment Linkage
Agreements between the Redevelopment Agency, Airway Scale Co. , and Superior
Loadce11 Co., Inc., as well as authorizing Agency Counsel to prepare a Memorandum
of Understanding (MOU) for execution between the Redevelopment Agency, City of San
Bernardino and Community Development Department for reimbursement to the
Redevelopment Agency for new or relocating businesses outside of a project area.
Under the MOU the Agency administers all Employment Linkage Agreements. The
Agency's source of funds for this program is from tax increment funds. Under the
MOU the City has agreed to reimburse the Agency for those contracts outside of
designated project areas.
On April 20, 1987, the Community Development Department executed the Memorandum of
Understanding (MOU) between the City and the Agency pursuant to Airway Scale Co.
and Superior Loadcel1 Co., Inc., linkage agreements. With the approval of the
upcoming Fatburger project (outside a project area), it becomes necessary to amend
or revise the existing MOU to include this new linkage participant.
In an effort to alleviate the preparation and execution of a new MOU for each new
or relocating business outside a project area, John Wilson, City Attorney's
Office, has recommended that a revised agreement (the attached Memorandum of
Agreement) be substituted for the previously approved MOU. Emibit wAw of this
revised agreement enumerates all City Employment Linkage contracts and may be
amended from time to time by motion to provide for new linkage agreements.
Upon the Redevelopment Committee's review on June 25, 1987, Staff and the
Redevelopment Committee recommend approval of the new Memorandum of Agreement.

5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

7 SECTION I. The Mayor of the City of San Bernardino is
8 hereby authorized and directed to execute on behalf of said City
9 a Memorandum of Agreement between the Redevelopment Agency of the
10 City of San Bernardino and the Community Development Department

12 funding of various contracts, with such non-substantive changes
13 to said Memorandum of Agreement as may be approved by the Mayor
14 and Common Council. A copy of said Memorandum of Agreement is
15 attached hereto as Exhibit "Aft and incorporated herein by this
16 reference as though fully set forth at length.
17 SECTION 2. All other Memorandums of Agreement concerning
18 the establishment of the Employment Linkage Program for the
19 enterprises set forth on Exhibit "A" hereof are hereby rescinded.

OF THE CITY OF SAN BERNARDINO CONCERNING EMPLOYMENT LINKAGE
FUNDING OF VARIOUS CONTRACTS
THIS AGREEMENT, made and entered into the
C:ay of
, 1987, by and between the REDEVELOPMENT AGENCY
OF THE CITY OF SAN BERNARDINO, hereinafter WAgency", and the
COMl1UNITY DEVELOPMENT DEPARTMENT OF THE CITY OF SAN BE~~ARDINO,
hereinafter "City", sets forth the agreement between the parties
concerning the reimbursement of expenses for an employment
linkage program for various employers in the City.
The parties hereto agree as follows:
I. (A) Agency has entered into agreements between the
Redevelopment Agency of the City of San Bernardino and the
employers set forth in Exhibit "An, attached hereto and made a
part hereof, as though set forth at this point, regarding
establishment of an employment linkage program. The agreement
contemplates
payment to the employer of $500 for each new job

$500 for each new certified employee who completes
created,' and
nine months of service in a newly created job.

(B) Agency shall serve as "J,ead Agency" in all
~mp10yment linkage agreements for both City and Agency. Agency
agrees to make such payments as are appropriate under such
agreements. After such payments have been made, Agency shall,
from time to time, invoice City for reimbursement of payments
made by Agency for this program.
(C) Invoicing shall not occur and City shall not be
obligated to reimburse any payment made to any employer which
is within a Redevelopment Project Area or which relocates to

a site within a Rede~lopment proje~Area, except for funds
earned by any such employer prior to such relocation.
2. City agrees to reimburse Agency for all funds expended
by Agency for Employment Linkage contracts enumeratE!d in
Exhibit "A" attached hereto. City agrees to reimburse Agency
for any other such Employment Linkage contracts of which City
has been notified in writing and to which the City has agreed
in writing. City shall be obligated to make reimbursements
where the employer remains outside all Redevelopment Project
Areas, and shall reimbursement payments earned by the employer
prior to relocating into a Redevelopment Project Area. A memo
from the Director of Community Development shall satisfy the
requirement for City consent.
3. The parties further agree that in the event the basic
contract between Agency and any employer is amended to
substantially increase those liabilities of Agency for which
City is obligated to make reimbursement hereunder, consent of
the City to such additional obligation by written memo from the
Director of Community Development shall be required.
4. Exhibit "AW may be amended by Agnecy to bring other
employers within this Agreement. In adding any additional
Linkage contracts, prior to City becoming obligated to make
reimbursement to such additional contracts, Agency shall advise
City of the maximum dollar commitment for each such contract,
and provide the other information specified in Exhibit "A",
attached hereto
