STAFF REPORT
Resolution No. 1160 adopted by the Board of Building Commissioners on June 5, 1987,
confirming assessments for weed abatement and debris removal work performed on ten
parcel s.
No written protest were received prior to the Board of Building Commissioners' meeting
on June 5, 1987.
Section 8.27.140 of the Municipal Code deals with the refunding of the amount of an
"erroneous" assessment. While it is stretchi ng it somewhat to say that bill i ng the
person in whose name the property was registered at the time the work was performed
was an error, the Municipal Code makes no provision for excusing the new owner of the
debt and removing the charge as a lien against the property. In the past, liens were
placed on properties once a year. Accordingly, the case often occurred where the new
owner never received "Notice to Clean" his/her property. To reduce the amount of
protest received for this reason, on the recommendation of the Legislative Review
Committee, we will in the future bring these matters before the Mayor and Council on
a monthly basis.

REAL PROPERTY LOCATED WITHIN THE CITY
3 COSTS OF THE ABATEMENT.
BERNARDINO CONFIRMING COSTS
IMPOSING LIENS ON CERTAIN
OF SAN BERNARDINO FOR THE

WHEREAS, The City of San Bernardino, pursuant to its
5 authority under Chapter 8.27 of the San Bernardino Municipal Code,
6 did lawfully cause public nuisances to be abated on the properties
7 described in Exhibit "A" attached to and incorporated in this reso
8 lution; and
9
WHEREAS, notice was given to the owners of record of said
10 pro perties, and a hearing has heretofore been held to hear pro-
11 tests and assess the costs of said abatements before the Board of
12 Building Commissioners.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
14 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1.
Said costs are found to have been incurred by
16 the City pursuant to proceedings under the San
Bernardino
17 Municipal Code, and the final statement of costs on file with the
18 City Clerk is hereby confirmed and adopted as special assessments
19 against the properties listed in Exhibit "A" hereto.

SECTION 2. If any of the sums due are not fully paid to
21 the City Clerk, City Hall, San Bernardino, before July 6, 1987,
22 then each of these unpaid sums shall be and become a lien of the
23 subject property pursuant to the Municipal Code and applicable
24 laws and shall be collected as a special assessment thereon.

SECTION 3. In the event any sum is not paid as hereinabove
26 provided, the City Clerk is hereby directed to file a certified
27 copy of this resolution, including Exhibit "A" showing such sums
28 as remain unpaid, with the Recorder and the Auditor of the County

of San Bernardino, State of California, directing that each such

sum be entered as
a lien charged against the property
as
it ap-
2 pears on the current assessment rolls, to be collected at the same
3 time and in the same manner, subject to the same penalties and
4 interest upon delinquencies, as the general taxes for the City of
5 San Bernardino are collected.
