PROBLEM: An annual resolution is required to authorize execution of an agreement between the City of San Bernardino and Dr. Robert W. Miller to conduct psychological examinations for Police Department pre-employment examination purposes. II. RECOMMENDATIONS: The City of San Bernardino adopt a resolution authorizing the execution of an agreement with Dr. Robert W. Miller to conduct pre-employment psycho- logical examinations for fiscal year 87/88. II], FINDINGS: An exami nat i on of the records in the Po lice Department refl ects that an agreement between the City of San Bernardino and Dr. Robert W. Miller was entered into on November 8, 1984. (resolution #84-452) The records do not reflect whether an RFP was published prior to the action by the Council adopting the proposal in November 1984. There has been no RFP sent out in subsequent years, because the price for unit billed has not altered. The cost of $125.00 per person examined will remain and is considered reasonable in comparison to some other local entities providing such services. Sampling telephone inquiries of some local Health Service entities support this contention. The services provided by Or. Miller have been satisfactory, timely and comprehensive. There is no current RFP prior to submission of this agree- ment due to the fact that there is no deviation of services obtained as stated in prior Council adopted actions relating to this subject. 75-0264 c o o o 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND DIRECTING THE EXECUTION OF A SIXTH AMENDMENT TO AGREEMENT WITH 3 DR. ROBERT WARBURTON MILLER PROVIDING FOR A ONE-YEAR EXTENSION OF THE CONTRACT RELATING TO PSYCHOLOGICAL EXAMINATIONS FOR THE 4 POLICE DEPARTMENT AND AMENDING PARAGRAPH 3 OF THE AGREEMENT. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 SECTION 1. The Mayor of the City of San Bernardino is 8 hereby authorized and directed to execute for and on behalf of 9 said City a Sixth Amendment to Agreement with Dr. Robert 10 Warburton Miller providing for a one-year extension of the 11 contract relating to psychological examinations for the Police 12 Department. 13 SECTION 2. '~j 15 16 17 18 19 20 21 22 23 24 25 26 27 28 6/29/87 Mayor of the City of San Bernardino 2 o o o o 1 2 3 SIXTH AMENDMENT TO AGREEMENT (Psychological Examinations) THIS SIXTH AMENDMENT TO AGREEMENT is made and entered into 4 effective the 1st day of July, 1987, by and between the CITY OF 5 SAN BERNARDINO, a municipal corporation, hereinafter called 6 "City", and DR. ROBERT WARBURTON MILLER, a licensed clinical 7 psychologist, hereinafter called "Miller". 8 City and Miller agree as follows: 9 1. Recitals. 10 A. City and Miller entered into an Agreement on May 15, 11 1979, a First Amendment to Agreement on April 21, 1980, a Second 12 Amendment to Agreement on April 6, 1981, a Third Amendment to 13 Agreement on December 6, 1982, a Fourth Amendment to Agreement on 14 May 15, 1984, and a Fifth Amendment to Agreement on September 17, 15 1986 (hereinafter collectively called "the Agreement"), relating 16 to psychological examinations for the Police Department. 17 B. The parties now desire to amend the Agreement to 18 provide for a one-year extension of its term. 19 2. Term. The term of the Agreement is extended for an 20 additional period of one year commencing July 1, 1987, and 21 terminating June 30, 1988. 22 3. A written report shall be rendered within one week of 23 the date the examination is scheduled. The written report shall 24 include a personality description, psychological fitness for the 25 duties of police officer, with a recommendation for the 26 acceptance or rejection for psychological reasons. Each written 27 report shall also be accompanied by "An Authorization for the 28 1 EXHIBIT A o o o o 1 Release of Medical Information by a Provider of Health Care" in a 2 form consistent with the provisions of California Civil Code 3 Section 56.11. 4 4. Other Provisions.
