CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect: Resolution supporting the State of California, Department of Transportation and San Bernardino Association of Governments Plan to expend State Funds for Right of Way Acquisition for State Route 210 (Formerly known as State Route 30). Background: The San Bemardino Association of Governments (SANBAG) is in the process of designing the extension of State Route 210 Freeway westerly of "H" Street. Upon completion of design, the right-of-way for the project will be acquired by the State of California Department of Transportation (Caltrans) and construction will begin shortly thereafter. Approximately 250 parcels in the Freeway main corridor will have to be fully or partially acquired. The parcels to be acquired have been identified based on an alignment which has been reviewed and accepted by City Staff. The latest alignment was presented to the Mayor and Common Council in a workshop on August 10, 2000, and comments received during the workshop have been conveyed to SANBAG. Adoption of this Resolution will enable Caltrans to proceed with the acquisition of parcels contained within the main line corridor of the proposed freeway according to section 100.21(b) of the Streets and Highways Code provided that the alignment is not an issue. The Resolution further encourages Caltrans to expend funds for the accelerated acquisition of parcels in connection with the construction and improvement of State Route 210 Freeway (formerly known as State Route 30). WHEREAS, the State Route 210 (30) Freeway was initially adopted in 1949; and WHEREAS, a Record of Decision relative to the Environmental Impact Statement was entered in September 20, 1996, and a Notice of Determination by the California Transportation Commission filed October 3, 1996 in compliance with Section 21108 of Public Resources Code to allow the construction and improvement of the State Route 210 (30) Freeway; and WHEREAS, the right-of-way acquisition for this construction and improvement requires the full or partial acquisition of approximately 250 parcels; and WHEREAS, Section 100.21(b) of the Streets and Highways Code allows the purchase of parcels contained within the main line corridor of the proposed freeway, provided that the alignment of the freeway is not at issue, upon adoption of a resolution by the City Council of the affected municipality. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the State of California, Department of Transportation be encouraged to expend funds for the accelerated acquisition of parcels in connection with the construction and improvement of State Route 210 (30) Freeway; and SECTION 2.
