Resolution awarding a contract to R. Moody Construction, Inc. for the construction of
twenty kennels at the Animal Shelter.
BACKGROUND
The Animal Shelter is located at 333 Chandler Place. This facility provides a holding area for
lost, abandoned, and impounded animals of all types. The shelter provides these services for
the Cities of San Bernardino, and under contract to, Fontana, Lorna Linda, and Colton.
Senate Bill 1785, which became effective on July 1, 1999, increased the holding periods
required for animals in a shelter and has greatly impacted this facility. Staff has determined
that twenty more dog kennels are needed to comply with this law.
A notice of the Request For Proposal # F01-41 was mailed to over seventy vendors, the San
Bernardino Chamber of Commerce, and advertised in the newspaper and on the Internet.
Six contractors attended the job walk and three bids for the project were received on
October 3, 2000. A panel consisting of Jon Cicirelli, Director of Animal Control, and Jim
Sharer, Director of Facilities Management, interviewed the vendors, reviewed the proposals
and rated them on a scale using six rating criteria. The criteria were price, completeness of
proposal, design, kennel manufacturer, sewage system, and site preparation. The bids ranged
from $121,920.00 to $155,000.00, with R. Moody Construction, Inc. being the lowest bidder
and the highest score on the ratings sheet. The proposals contained the following prices for
the project:

FINANCIAL IMPACf
The cost to build the new kennels is $121,920. $100,000 for kennels was included in the
Adopted FY 2000-2001 Animal Control Budget. An additional $21,900 (rounded) will be
required to be transferred from the General Fund's unappropriated/undesignated fund
balance to the Animal Control Fund. This will reduce the General Fund's estimated
unappropriated/undesignated fund balance from $1,921,192 to $1,899,292.
MOTION
Adopt resolution, and authorize the Director of Finance to amend the FY 2000-2001
Adopted Budget and transfer $21,900 from the General Fund's unappropriated/
undesignated fund balance to the Animal Control Fund to be appropriated to account #

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF SAN
BERNARDINO AUTHORIZING THE EXECUTION OF A CONTRACT WITH R.
MOODY CONSTRUCTION, INC. FOR THE CONSTRUCTION OF TWENTY
KENNELS AT THE ANIMAL SHELTER, 333 CHANDLER PLACE, IN SAN
BERNARDINO.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. R MOODY CONSTRUCTION, INC., is the lowest responsible bidder
for the construction of twenty kennels at the Animal Shelter per Plan No. FOI-41. A contract is
awarded accordingly to said bidder in a total amount of $121,920.00. Such contract shall be
effective only upon being fully executed by both parties. All other bids, therefore, are hereby
rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the
City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by
reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of the passage of this resolution.

Project Specifications Number F 01-41, all of which are made a part thereofand collectively
evidence and constitute the contract.
The Contractor hereby agrees to commence work under this contract on or before a date to be
specified in a written "Notice to Proceed" of the Owner and to fully complete the project within
90 working days thereafter. The Contractor further agrees to pay, as liquidated damages, the
sum of $100.00 for each consecutive calendar day in finishing the work in excess of the number
of working days prescribed above.

Job: Animal Shelter
Design Build

We propose to furnish plans, pennits and all materials and labor to construct the new
animal shelter per job walk on 9/12/00:
"
We would like you to consider our design using concrete masomy construction on the end
walls to greatly increase the insulation value over a sheet metal wall. Also, we propose an
open web truss roof with the roofing material to be asphaltic cap sheet. This will reflect
heat instead of transferring the sun's rays as a metal roof does.
Our design also uses 12" x 12" masomy columns with beams in between to support roof.
This is not only structurally sound, but is also a more attractive exterior finish. Between
each colunm there will be chain link fencing up to 7 feet to keep people out as requested
at the job walk.
The kennels will be provided by T -Kennel Systems, Inc. as per quote provide by city. We
will provide plumbing and electrical to match existing kennel per plans provided by city.
This will include, but not shown on plan:
a) Under concrete geo-therma1lines.
b) Two (2) evaporative coolers - roof mounted.
c) Catch basins at each trough drain.
d) R-30 insulation - ceiling.
e) Six (6) foot wide sidewalk around perimeter of kennel. (Outside of chain link).

R. Moody Construction, Inc. for the construction of 20 kennels at the Animal Shelter, 333

The original agreement is enclosed for your signature. Please sign in the appropriate
location and return the original agreement to the City Clerk's Office, Attn: Linda
Sutherland, P.O. Box 1318, San Bernardino, CA 92402, as soon as possible. Please be
advised that the agreement will be null and void if not executed by January 5, 2001.
