equIvalent Sewer CapacIty RIghts to the Board of Hater CommIssIoners of the
CIty of San BernardIno for an amount not to exceed $1,367,300.00,
BACKGROUND
In 1984, the Agency purchased 800 sewer capacity rIghts ("SCR's") to be
utIlIzed as an IncentIve for commercIal development wIthIn the redevelopment
project areas. In the fIve years sInce theIr purchase, the Agency has
utIlIzed 95 SCR's on the followIng projects:

The Hater Department has submItted a request to repurchase the Agency's SCR's
as they no longer wIsh to fInance expansIon through thIs means and wIll now be
able to meet demand as It occurs though a serIes of modular expansIons (see
the attached schedule and InformatIon).
Staff has determIned that the Agency now holds 705 SCR's and, as experIence
has shown, the demand does not justIfy the reserves now held, It Is therefore
proposed that 605 SCR's be sold to the Hater Department for $2,260.00 an SCR,
for a total of $1,367,300,00. The purchase prIce Is based upon terms set out
In the orIgInal Purchase Agreement dated 10/1/84, Staff recommends holdIng
100 SCR's In reserve for future development even though we are told that
future demands wIll be met as they occur.
RECOMMENDA nON
It Is recommended that the CommIssIon approve the sale of 605 sewer capacity

Dear Steve;
The Redevelopment Agency acquired 800 sewer capacity rights in
accordance with the "Purchase Agreement for Wastewater Treatment
Plant Capacity Rights" dated October 1, 1984 with the Board of
Water Commissioners.
In accordance with Section 9 of the purchase agreement, the Board
will acquire at a price of $2,260 per sewer capacity right, any
rights the Redevelopment Agency is willing to return for resale.
I have attached, for your information, a listing of projects which
will increase the Wastewater Treatment Plant's capacity and the
projected dates the facilities will be on line,
