STAFF REPORT A request for annexation was received ~ the City from the owner of an approximately 8 acre parcel, located East OE Curtis St. and North of Coulston st. Since the parcel is not contiguous to any City ,boundaries, the petitioner, after meeting and conferring with staff, has expanded his petition to include the entire County Island. The City had previously initiated proceedings for this annexation, and, .on February 17, 1986, a resolution making application was filed with LAFCO. The petitioner of that request had subsequently lost interest in annexation and proceedings were terminated. There has since been renewed interest, and the current petitioner had indicated to us that there were several other owners in the area that showed interest in annexation. On September 2, 1989, the Director of Public Works/City Engineer and the City Clerk were authorized to proceed with the proposed annexation. A RESOLUTION OF THE CITY OF SAN BERNARDINO MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO FOR THE ANNEXATION OF THE TERRITORY LOCATED NORTH OF THE 1-10 FREEWAY, BETWEEN TIPPECANOE AVENUE AND MOUNTAIN VIEW AVENUE. WHEREAS, the Mayor and Common Council as the governing body of the City of San Bernardino desire to initiate proceedings pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Division 3, commencing with Section 56000 of the California Government Code, for the annexation of the area generally located North of the 1-10 Freeway, between Tippecanoe Avenue and Mountain View Avenue. WHEREAS, the territory proposed to be annexed is inhabited, and a description of the boundaries of the territory is set forth in Exhibit "C" attached hereto and incorporated by reference as fully as though set forth in length herein; and WHEREAS, this proposal is consistent with the sphere of influence of the affected City; and WHEREAS, the reason for this proposed annexation is as follows: a) A petition to annex was submitted by a property owner within the proposed territory for annexation. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The lIllYor and Me.bers of the Co_on Council of the City of San Bernardino agree and desire to annex the above described territory to the City of San Bernardino, for the following reasons: 1. The territory 'Proposed to be annexed is contiguous to the corporate limits of said City on ~wo sides. 2. The incorporation of this territory will help contribute to and facilitate the orderly growth and development of the existing City area and the territory proposed to be annexed. This proposed annexation is within the sphere of Influence for the City of San Bernardino. 3. This annexation will also help to provide a unifol'll and orderly lIllIIIIer of growth, planning and zoning of lands, and the subdivision of lands therein in such a lIllIIIIer most conductive to the welfare of said City and the area proposed for annexation. 4. The City of San Bernardino has planned for providing all typical' City services to the area under consideration for annexation. The following is an enUlleration and description of services which will be extended to the affected territory, which describes the level and range of such services that will be provided, as well as the feasibility of extending such services and any iaprovements that will be required by the City, along with a description of when the service will co..ence and the financing of such iaprovements and services and any conditions i.posed by the City. a) Planning, Zoning, Code Enforcement and Building Inspection The City shall provide these services in conformance with appropriate Government Codes and City Ordinances as well as following the City's General Plan for zoning and subject to the provisions o( Land Use Ordinance No. 1991. This function is supported by City taxes and appropriate zoning, building and pel'llit fees. b) Parks and Recreation - The area proposed for annexation will have no Jiipact on park or recreational facilities or progrllll8, and no additional services will be required as a result of the annexation. The cost to the taxpayer within the proposed annexation will be collected through the City taxes and by required fees charges to those individuals who wish to participate in City-sponsored recreational activities where charges and fees are applicable. c) Library Service - It is important to note that the resources of the entire library system are readily made available to the proposed annexation, including the Central Library located at 6th and "E" Streets. The cost for these services are paid through City taxes and become available i..ediately upon annexation. -2- I (j-t3 - 4-Gt o o .' d) Public safety, Police - The San Bernardino Police De~ent is authtirized a co.pl~ent of 244 sworn offi~ers and approxi.ately 128 civilians not'coUnting 72 school crossings guards. The Patrol Division lIllinta1ns 6 beat areas of the City. The Division presently averages 24 Police units on patrol 24 hours a day, counting supervisory and traffic personnel. The Detective Division has 30 sworn officers and works from 8:00 a.m. to 5:00 p.m. daily, Monday through Friday. The Services Division lIllintains all records and identification and provides support services to the other two Divisions on a 24 hour a day basis. The cost for these services are paid through City taxes, and become available iaaediately upon annexation. e) Public Safety, Fire, Paraaedic and Rescue - Fire protection services will be provided upon annexation and the affected residents will be provided with a Class 3 rated Fire department with eleven (11) differ~nt fire stations to respond. A typical structural fire on the first. alara deploys two (2) engine cOllpaJ1ies, one (1) ladder truck cOllpaDy, a parlllledic squad and one (1) Battalion, Chief. In addition to fire protection, the City also has a miniaua of four (4), paraaedic units on duty 24 hours a day. Each unit has two (2) paraaedics each, giving a total of eight (8) paraaedics on duty at all tiaes. Also, the City is equipped with helicopter assistance for rescue and/or evacuation services when required. The closest station to the proposed annexation area is Fire Station No. 11, located at 450 Vanderbilt Way. The cost for these services are paid through the City taxes and becoae available iaaediately. f) Public Safety, Aabulance Service - The City of San Bernardino, under Ordinance No. 1987, franchise to Courtesy Ambulance Coapany as the only aedical transportation carrier within the City limits. The rates are established ~ the above ordinance and fees are paid ~ the user. , g) Water and Sewer services - The Area is currently served ~ South San Bernardino Water Coapany, and they will re.ain to serve this area for the time. The treatJIent, disposal and reclamation of wastewater is procl!,SSed ~ the City of San Bernardino's Trea1:llent Plant. Sewer services would be available to the residents of the area upon annexation. The methods and availability of installing of sewer uins would vary, as would the financing for such projects (paid for ~ developers in the area, assessaent districts, etc.) h) Cable Television - The area is served ~ Comcast Cablevision, and they will continue to serve this area. i) Public utilities - Electricity, Gas and Telephone services - These services are currently provided to the project area. The City will allow service to continue upon annexation under present franchise agreements between the various utility collpaJ1ies. The rate structure and cost to the property owners are controlled ~ the Public Utilities Co..ission and any expansion of future service will be created ~ the request of developers and/or property owners. 10-/3- J-4 '-3- ." o o j) Solid Waste, Collection and Disposal - When the area is annexed, the City will' provide service at that ti.e. Also, if upon request, the City will provide refuse service to the eXisting custoaers, or at the end of the 5 year cancellation period, whichever co.es first. the current fee for twice a week pickup (residential) is $9.50 per aonth. k) Street Sweeping , lighting and aaintenance - Street sweeping is currently done a once a aonth basis. Street repair andlor aaintenance is 'done on an as needed basis. The costs for these services is paid through the City taxes, and the services beco.e available i_ediately upon annexation. 1) Transit - Upon annexation, the bus service provided for this area will reaain under control of Oanitrans. Oanitrans' long range transit plans are at the request of residents in the area through their Councilperson or directly to Oanitrans. Such change II\1St have the approval of the City Council. The short range transit plans calls for continuation of the present service lev~ls on these routes. Service level changes are aade twice a year, in January and in June, and are initiated at the request of the City Council andlor Oanitrans planning staff. ..t... 5. Special Taxes - In addition to the regular property taxes, an R utility tax is collected by the City to offset costs of the general services provided. This llIIOunt is billed and paid through the respective utility's billing process. 6. Conditions - There are no special conditions that will be ill]lClsed as a result of this annexation.
