STAFF REPORT
Bids for this project were opened at 2: 00 p.m., on
Tuesday, 10-31-89.
A total of 9 bids were received, ranging from $214,858.00
to $397,829.00. The low bid of $214,858.00 is 0.01% under the
Engineer's Estimate of $216,280.00.
Listed below is an estimate of the total estimated
project cost, based upon the actual low bid price.

Sub-Total $ 233,358
Contingencies (15%) :!: 35,642
TOTAL ESTIMATED PROJECT COST $ 269,000
An initial amount of $215,400 was allocated in ,the
1988/89 Sewer Line Construction Fund Budget. Supplemental funds,
in the amount of $54,600 were provided at the Council meeting of
10-02-89, for a total budgeted amount of $270,000.
We recommend that a contract be awarded for the low bid.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MAJICH BROTHERS, INC. FOR CONSTRUCTION OF AN
INTERCEPTING SEWER ALONG CABLE CREEK CHANNEL, FROM CAJON
BOULEVARD TO INDUSTRIAL PARKWAY.
BE IT RESOINED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS,
SECTION 1.
Majich Brothers,
Inc. is the lowest
responsible bidder for Construction of Intercepting Sewer along
Cable Creek Channel, from Cajon Boulevard to Industrial Parkway,
in accordance with Plan No. 7822, for the total amount of
$214,858.00,
and a contract is awarded to said bidder
accordingly, but such award shall be effective only upon the
contract being fully executed by the parties, all other bidf:
therefore are hereby rejected, and the Mayor is hereby authorized
and directed to execute said contract on behalf of the City, a
copy of the contract is attached hereto, marked Exhibit "A" and
incorporated herein by reference as fully as though set forth at
length.
SECTION 2. This contract and any aMendment or rnodifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (601 days of the
passage of this resolution.
