STAFF REPORT For a number of months, staff has been working on revisions to the street Banner Ordinance and Resolution. Planning and Building and Safety Departments and Public Buildings have provided input regarding proposed changes. Attached for your review are the proposed amendments to the ordinance and resolution. These proposed amendments were recommended for full Council approval at the Legislative Review Committee meeting of June 22, 1989. A summary of the ordinance changes is as follows: Section 16.16.010 16.16.010 (B) 16.16.010 (E) 16.16.020 (A) 16.16.040 16.16.060 19.60.100 (A) 75.0264 Provides a definition of a street banner (Definition a banner extended over a public street or other public property, either on an established bridge or independently suspended) . Deletes reference to banners; adds wall and/or roof banners; deletes reference to C-a, C-2, C-3, C-3A, C 4, C-M, M-1, M-1A and M-2 zones, generalizes to commercial and manufacturing zones, changes reference for time period to 45 days from 6 months for flags and 12 months o o for pennants; adds wording -- such temporary sign permits shall not be granted to the business or location more than twice during a year and that the 2 permitted time period shall not be granted consecutively, but separated by a time period of at least 60 days. 19.60.100 (C) Adds new section. The Resolution establishes the fee and process for actual placement of street banners. The current resolution sets the fee at $100. Public BuildingS/Parking Control SUBJECT: Fee for Street Banners DATE: June 8, 1989 COPIES: ------------------------------------------------------------- Attached memo dated July 6, 1988 clarified and established responsibilities and duties of Public Buildings Division in regard to installation and removal of Street Banners. Attached to memo is a copy of Resolution 85-001, which establishes the fee to cover the cost of permits issued for the installation and removal of Street Banners, which was adopted January 11, 1985. We have analyzed the cost based upon the latest salary and benefits, etc. and find the $100.00 fee to cover only 50% of the total cost. Our calculations follow, and indicate that our current cost exceeds $200.00 per installation and removal Recommend consideration be given to adjustment of this fee, from $100.00 to $200.00 per banner. ~VERSTREET' pt. RESOLUTION OF THE PROCEDURES FOR PLACEMENT REPEALING RESOLUTION NO. CITY OF OF STREET 85-1. SAN BERNARDINO RELATiNG TO BANNERS WITHIN THE CITY, AND BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Fees. Pursuant to section 16.16.040 of the San Bernardino Municipal Code, the fee to be deposited with the City in an amount intended to cover the cost of permit issuance 8 and the cost of erection and removal of each street banner is 9 established at $200.00 This fee shall not be refundable unless 10 the banner is denied. 11 SECTION. 2. Application. The City Administrator, or 12 his designee, shall be authorized to issue a street banner 13 permit to any applicant meeting the requirements of Chapter 14 16.16 of the San Bernardino Municipal Code, at such time as the 15 applicant has completed a proper application and paid the 16 $200.00 fee. No permit shall be issued unless all of these 17 requirements have been satisfied. 18 SECTION. 3. Specifications. Each street banner shall 19 be constructed in a manner to comply with the specifications 20 prescribed by the City Administrator. 21 ~ 23 SECTION. 4. Resolution No. 85-1 is hereby repealed.
