ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDI~G SAN
BERNARDINO MUNICIPAL CODE SECTIONS 9.l2.0l0, 9.l2.030 SUBSECTION
BAND 9.l2.040 SUBSECTION A AND REPEALING SAN BERNARDINO
MUNICIPAL CODE SECTION 9.l2.020.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION l.
9.l2.0l0 of the San Bernardino Municipal Code
is amended to read as follows:
"9.l2.0l0 Interference with City business. Every person~
except officers or employees of any governmental agency on
official business, who willfully interferes with the good order,
lawful conduct or administration of any municipal program or
activity of the City, or with any City official .in the
performance of his or her duty, with the intent to disrupt,
obstruct or to inflict damage to property or bodily injury upon
any person, is guilty of a misdemeanor or an infraction which,
upon conviction thereof, is punishable in accordance with the
provisions of Section l.l2.0l0 of this Code."
SECTION 2.
9.l2.030 Subsection B is amended to read as
follows:
"B. Any person who has been directed to leave a City
building or facility pursuant to subsection A above and who
thereafter fails to inunediately leave such building or facility
or who willfully and knowingly re-enters such building or
facility within seventy-two hours after being directed to leave,
is guilty of a misdemeanor or an infraction which. upon
conviction thereof, is punishable in accordance with the
provisions of Section l.l2.0l0 of this Code."

SECTION 3.
9.l2.040 Subsection A is amended to read as
2 follows:

"A. Any person, other than an authorized public officer or
4 employee acting within the course and scope of his or her
5 employment, who enters or remains in any municipal building or
6 facility with the knowledge that such building or facility is
7 closed to the public and, who does not have the present consent
E! of an official of the City for his or her presence in the
9 building or facility, is guilty of a misdemeanor or an
lO infraction, which, upon conviction thereof, is punishable in
11 accordance with the provision of Section l.l2.0l0 of this Code."

SECTION 4. San Bernardino Municipal Code Section 9.l2.020
l3 is hereby repealed.
l4 I HEREBY CERTIFY that the foregoing ordinance was duly
l5 adopted by the Mayor and Common Council of the City of San
l6 Bernardino at a meeting thereof, held on the
