Animal Control Officers are empowered to arrest and issue notices to appear for violations of laws governing animals but other employees are not. Staff is requesting that the Mayor and Council authorize other employees of Animal Control the power to issue notices to appear for violations of Title 6 (animals) and 12.44,070(sanitation) of the San Bernardino Municipal Code. This will reduce the burden on the Animal Control Officers and provide for a more effective enforcement program, 75-0264 o 4L 4 UJ - o o o 1 ORDINANCE NO. 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION 9.90.010 SUBSECTION (A) OF THE SAN BERNARDINO MUNICIPAL CODE TO 3 AUTHORIZE THE DIRECTOR OF ANIMAL CONTROL, ANIMAL LICENSE CHECKERS, ANIMAL SHELTER ATTENDANTS AND ANIMAL HEALTH TECHINCIANS 4 TO ISSUE NOTICES TO APPEAR FOR VIOLATIONS OF TITLE 6 or THE SAN BERNARDINO MUNICIPAL CODE. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 6 DO ORDAIN AS FOLLOWS: 7 8 SECTION 1: Section 9.90.010 Subsection (A) of the San Bernardino Municipal Code is amended to read: 9 10 "9.90.010 Arrest - Citation A. Pursuant to Section 836.5, 853.5 and 853.6 of the 11 California Penal Code, the employees as listed in each subsection 12 herein are authorized and empowered to arrest and issue notices 13 to appear for violations of the provisions of the San Bernardino 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Municipal Code as hereinafter set forth: 1. Security guard personnel, who shall be off duty or retired police officers or reserve police officers, employed by the Redevelopment Agency of the City of San Bernardino pursuant to an agreement between said Agency and the City, relating to a security guard program, are authorized and empowered to arrest and issue notices to appear for violations of the provisions of Chapters 5.04, 8.15, 9.48, 12.44, and Sections 9.12.030 and 10.16.210 for incidents arising in the Central City Mall and public areas in, adjacent to, or immediately surrounding said mall. 2. Police Assistants are authorized and empowered to arrest and issue noticeS to appear for violations of the provisions of this Code and State statutes pursuant to California Penal Code Section 836.5. 1 LM:mw 7/7/88 1 - lib - .L o ORDINANCE AMENDING ~TION 9.90.~0 SUBSECTION (A) OF SAN BERNARDINO MUNICIP~ODE \.I o 1 3. The Planning Director, Principal Planners, Senior 2 Planners, Planners II, Planners I and Planning Aides are 3 authorized and empowered to issue notices to appear for 4 violations of the provisions of Titles 18 and 19 of this Code and 5 for violations of Chapter 8.15, 8.21, 8.24, 8.27, 8.33, 8.36, 6 10.16 ana 15.52 of this code. 7 4. The Director of Water Reclamation, Environmental 8 Control Representative, and Environmental Control Technicians are 9 authorized and empowered to issue notices to appear for 10 violations of Chapter 13.32 of this code. n 5. The Director of Building and Safety and Code Compliance 12 Officers are authorized and empowered to issue notices to appear 13 for violations of the San Bernardino Municipal Code and all other 14 codes incorporated herein by this reference. 15 6. The City Attorney Investigators are authorized and 16 empowered to arrest and issue notices to appear for violations of 17 this code and State Statutes pursuant to California Penal Code 18 Section 836.5. 19 7. The Director of Animal Control, Animal License 20 Checkers, Animal Shelter Attendants, and Animal Health 21 Technicians, are authorized and empowered to issue notices to 22 appear for violations of Title 6 and Section 12.44.070 of the San 23 Bernardino Municipal Code.
