The state has updated its building codes and has established the date of January 1, 1990 as the latest date that local governments can begin enforcing the new state Building Codes. In addition, the adoption of these codes as part of the city's Municipal Code provides for local enforce- ment and administration. (Establishes the Board of Building commissioners, fees and waiver of certain fees, etc.) The proposed ordinance is proposing two significant amendments to the state Building Codes (International Conference of Building Officials, I.C.B.O. Uniform Building Code). Both of these amendments set higher standards than the I.C.B.O Model Code. First, is to require all fences in a front and side yard to obtain a building permit: and all masonry fences, regardless of height or location, to obtain a building permit prior to construction. These changes are being proposed because of the number of fences built in front yards in violation of the City's vision clearance regulation and the number of masonry fences that have been built without footings that have fallen over. Second, is the reduction of space between rails and ornamental patterns of open guard rails along stairs, landings and balconies, etc. from 6 inches to 4 inches. This change is being made because a 6 inch space allows a small child's head and body to pass through and fall. In order to help notify the public of these changes, the department will send out a news release and notification to the Professional Design and Construction Associations. In addition, the Plan Review Division routinely notes this type of change/correction on the approved construction plans prior to issuance of permits. "c_^""~." o o o ORDINANCE NO. ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS 15.04.0l5, l5.04.020, 15.04.050, 15.04.060, 15.04.070, 15.04.075, 15.04.07~, 15.04.080, 15.04.082, 15.04.085, 15.04.087, 15.04.095 AND l5.04.l00 OF THE SAN BERNARDINO MUNICIPAL CODE, TO ADOPT THE UNIFORM BUILDING CODE, 1988 EDITION, THE UNIFORM BUILDING CODE STANDARDS, 1988 EDITION, UNIFORM HOUSING CODE, 1988 EDITION, 'UNIFORM SIGN CODE, 1988 EDITION, UNIFORM ADMINISTRATIVE CODE, 1988 EDITION, UNIFORM BUILDING SECURITY CODE, 1988 EDITION, UNIFORM MECHANICAL CODE, 1988 EDITION, UNIFORM PLUMBING CODE, 1988 EDITION, UNIFORM SWIMMING POOL SPA AND HOT TUB CODE, 1988 EDITION, NATIONAL ELECTRICAL CODE, 1987 EDITION, STRUCTURAL WELDING CODE, 1988 EDITION, AND AMENDMENTS THEREON. WHEREAS, pursuant to California Health and Safety Code Section 17958, local governing bodies are required to adopt regulations imposed by Section l7922 of the California Health and Safety Code; and WHEREAS, pursuant to Section l7958 of the California Health and Safety Code, a City may make changes in the provisions adopted pursuant to Section 17922 of the California Health and Safety Code; and WHEREAS, it is necessary to update codes incorporated into the San Bernardino Municipal Code. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Section 15.04.0l5 is hereby added to the San Bernardino Municipal Code as follows: "15.04.015 Purpose. The purpose of this code is to provide minimum standards to safe-guard life or limb, health, property and publiC welfare by regulating and controlling the design, construction, quality of materials, use and occupancy, location and maintenance of all buildings and structures within this jurisdiction." Section 15.04.020 of the ,San Bernardino 2 Municipal Code is hereby amended as follows: 3 "15.04.020 Adoption of Codes by Reference. 4 Those certain rules and regulations, as set forth in the 5 following codes, appendices and new standards are hereby adopted 6 by reference as the regulations governing the erection, 7 construction, alteration, repair, removal and maintenance of all 8 buildings and other structures in the City: 9 ( 1 ) Uniform Building Code, including Appendix, Chapters l, 7, ll, l2 - Div. II only, 23 - Div. II only, 32, 35, 38, 49, 5l, 53, 55, 57, 70 of the International Conference of Building Officials, 1988 Edition; ( 2 ) Uniform Building Code Standards of the International Conference of Building Officials, 1988 Edition; ( 3 ) Uniform Housing Code of the International Conference of Building Officials, 1988 Edition, except its definition of 'substandard buildings'; (4) Uniform Administrative Code of the International Conference of Building Officials, 1988 Edition; ( 5 ) Uniform Building Security ~ode of the International Conference of Building Officials, 1988 Edition; ( 6 ) Uniform Sign Code of the International Conference of Building Officials, 1988 Edition; (7) Uniform Mechanical Code, including Appendix, Chapters A through D of the International Conference of PZjdys June 2l, 1989 2 C)- 10 11 12 13 14 15 16 l7 18 19 - 1 - j" o o () 1 Building Officials and the International Association of Plumbing and Mechanical Officials, 1988 Edition; 2 3 ( 8 ) Uniform Plumbing Code, including Chapters A 4 thorough I and IAPMO Installation Standards of the 5 6 International Association of Plumbing and Mechanical Officials, 1988 Edition; 7 (9) National Electrical Code of the National Fire 8 9 Protection Association, 1987 Edition; (10) structural Welding Code of the American Welding Society, 1988 Edition; (11) Uniform Swimming Pool Spa and Hot Tub Code of the International Conference of Building Officials and International Association of Plumbing and Mechanical Officials, 1988 Edition; and (l2) Uniform Code for Solar Energy Installations of the International Conference of Building Officials and International Association of Plumbing and Mechanical Officials, 1988 Edition. It shall be unlawful to erect, construct, alter, repair, 20 remove or maintain any building or structure in the City in 2l violation of, or without complying with the appropriate 22 provisions of the above codes. Section 15.04.050 and Section l5.04.060 of the 3 San Bernardino Municipal Code are hereby repealed. 4 SECTION 4. Section l5.04.070 of the San Bernardino 5 Municipal Code is hereby amended as follows: 6 "Section 15.04.070 Uniform Building Code Section 204(a) 7 amended - Board of Appeals. 8 The Board of Building Commissioners of the City of San 9 Bernardino shall serve as the Board of Appeals. The building lO official shall be Clerk of the Board. The Board shall have such II duties as are delegated to it by the Uniform Building Code as l2 adopted by the City, and other duties as may be delegated by l3 other provisions of the San Bernardino Municipal Code." l4 SECTION 5. Section l5.04.075 is hereby added to the San l5 Bernardino Municipal Code as follows: 16 "15.04.075 Uniform Building Code Subsection 30l (b) (2) 17 amended - Fences Not Requiring Permit. 18 Uniform Building Code Subsection 30l(b)(2) is amended as 19 follows: 20 A building permit shall not be required for fences not 2l over six (6) feet high, except fences located in front or 22 23 24 side yards will require a permit. All masonry block, including,concrete fences and walls, regardless of size or location, require a permit." ,25 SECTION 6. Section 15.04.080 of the San Bernardino 2 Municipal Code is hereby amended as follows: 3 "l5.04.080 Uniform Building Code Section 304 amended- 4 Fees. 5 A. Uniform Building Code Subsection 304(b) Permit Fees is 6 amended as follows: 7 The fee for each permit shall be as set forth in Table 8 Nos. 3-A through 3-D of the Uniform Administrative Code, 9 1988 Edition, subj ect to such amendments thereto as are 10 adopted in this chapter. II The determination or value or valuation under any of 12 the provisions of this code shall be made by the building 13 official, based upon the latest publication of building l4 valuation data printed by the International Conference of 15 Building Officials bimonthly Building Standards magazine. l6 The value to be used in computing the building permit and 17 building plan review fees shall be the total value of all 18 construction work for which the permit is issued as well as 19 20 2l 22 all finish work, painting, roofing, electrical, plumbing, heating, air conditioning, elevators, fire-extinguishing systems and any other permanent equipment." B. Uniform Building Code Subsection 304(c) Plan Review 23 Fees is amended as follows: 24 When a plan or other data is required to be submitted 25 by Subsection (b) of Section 302, a plan review fee shall 26 be paid at the time of submitting plans and specifications 27 for review. A fee of lOt of the building permit fee shall be charged for residential and nonresidential plan check and inspections to meet any state mandated energy requirements. A fee of lot of the building permit fee shall be charged for plan check and inspections of any state mandated regulations relating to handicappers imposed upon commerciai, multi- family and public buildings. Where plans are incomplete or changed so as to require additional plan review, an additional plan review shall be charged at the rate shown in Table No.3-A. c. Uniform Building Code Subsection 304(g) Exemption From Fees is added as follows: Fees shall be waived for the following: l. Historic Preservation - No fees shall be charged for permits issued for repairs, alterations or additions for the preservation, restoration or rehabilitation of a building or structure which is a qualified historical building or structure pursuant to Health and Safety Code Section 18955, a qualified historical property pursuant to Public Resources Code Section 5031, ,a registered historical landmark pursuant to Public Resources Code Section 5021, or a point of historical interest pursuant to Public Resources Code Section 5022.5. 2. Natural Disaster Damage - No fees shall be charged for permits issued to owners for demolition or first rebuilding of damaged or destroyed structures located PZ/dys June 21, 1989 6 - o. o o o 1 in an area designated as a disaster area by resolution of 2 the Mayor and Common Council. This exception shall apply 3 4 5 6 only to property owners of record at the time of the di,saster, and not to persons subsequently acquiring the property. 3. Charitable Organizations - Fees shall be waived 7 or refunded in accordance with Chapter 3.13 of the San 8 9 Bernardino Municipal Code." SECTION 8. Section l5.04.085 of the San Bernardino 10 Municipal Code is amended to read as follows: II "15.04.085 Uniform Administrative Code, 1988 Edition, Table l2 3-A through 3-D amended - Fees. l3 A. Uniform Administrative Code, 1988 Edition, Table No. 3- 14 A is amended by adding Nos. 5, 6 and 7 under Other Inspections l5 and Fees as follows: l6 l7 5. A fee in the sum of Fifty Dollars ($50.00) for the inspection of any existing property or building 18 required to be made by the Department of Building and 19 Safety for compliance with the National Housing Act, 20 2l 22 23 Section 221(d)(2) or other lending institutions and regulations thereunder shall be paid to the City by the applicant for such inspection service. 6. A fee in the sum of Twenty-five Dollars ($25.00) 24 for the inspection of a room addition, garage, patio, or 25 other portion of a building when the entire building need 26 not be inspected. 27 / / / / 28 PZ/dys June 21, 1989 7 o. lO 11 12 l3 l4 o o o 1 An annual sign permit fee for off-premise signs 7. 2 shall be Ten Dollars ($10.00) due and payable on the second day of January in any year, which fee shall be doubled if the permit is not obtained on or before the thirty-first (3lst) day of January; however, where the sign is first erected after January 3l of that year, only the Ten Dollar 3 4 5 6 7 8 ($10.00) fee shall apply. B. Uniform Administrative Code, 1988 Edition, Table No. 3- 9 B is amended by adding New Commercial Buildings as follows: New Commercial Buildings: The fee of $.Ol5 per square foot shall include all wiring and electrical equipment in or on each building or other electrical equipment on the premises constructed at the same time. C. Uniform Administrative Code, 1988 Edition, Table No. 15 3-C is amended by adding Nos. 2l, 22, 23, 24, 25 and 26 under l6 Unit Fee Schedule as follows: 17 18 19 20 2l 22 23 24 25 2l. Section l5.04.095 of the San Bernardino 6 Municipal Code is hereby amended as follows: 7 "15.04.095 Uniform Building Code Section l7ll amended- 8 Guardrails. 9 Uniform Building Code Section l7ll is amended as follows: lO Open guardrails shall have' intermediate rails or an II ornamental pattern such that a sphere four (4) inches in 12 diameter cannot pass through." l3 SECTION ll.
