STAFF REPORT
Arrowhead Valley Mutual Water Company acquired a blanket easement
across a 1,000 acre tract of land from Newmark Grain Company in
September, 1920. The Water Department acquired Arrowhead Valley
Mutual Water Company by agreement dated March 14, 1925.
The Hencks own a 4.86 acre parcel of land on the north side of 40th
Street, approximately 300 feet east of First Avenue that is within"
the 1,000 acre tract. They have requested that the "Blanket
Easement", as it affects their property, be quitclaimed to them so
that they will not have any encroachment problems during or after
they make any improvements. .
We have no facilities within their property and no need for a
blanket easement in the future. Our pipeline facilities are in the
dedicated right-of-way.
The Board of Water Commissioners, at their regular adjourned
meeting held on June 27, 1989, unanimously voted to quitclaim our
interests in the property as set forth in the attached document
reserving all the water and water rights we acquired, and
authorized the Secretary to submit the Quitclaim Deed to the Mayor
and Common Council for approval.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AUTHORIZING THE QUITCLAIMING OF RIGHTS-OF-WAY
WITHIN LOT 9, ARROWHEAD SUBURBAN FARMS, TRACT NO. "Aft.
WHEREAS, Arrowhead Valley Mutual Water Company acquired
blanket rights-of-way within a l,OOO acre tract of land from
Newmark Grain Company by Quitclaim Deed dated September l4,
1920; and
WHEREAS, Lot 9, Arrowhead Suburban Farms, Tract No. ftA", in
the County of San Bernardino, State of California, as per plat
recorded in Book 2l of Maps, Page 6, records of said County, is
within the l,OOO acre tract of land, and
WHEREAS, the City of San Bernardino, by and through it's
Board of Water Commissioners acquired Arrowhead Valley, Mutual
Water Company by agreement dated March l4, 19251 and
WHEREAS, any water distribution pipelines, ditches, canals
or other facilities that may have been located within Lot 9,
Arrowhead Suburban Farms, Tract No. "A", have been abandoned and
there is no longer a need for the right-of-ways.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

That as successor-in-interest to the rights, title and
interest acquired by Arrowhead Valley Mutual Water Company from
Newmark Grain Company by Quitclaim Deed dated September l4,
1920, all rights-of-ways as set forth in the Quitclaim Deed, a
copy of which is attached hereto marked Exhibit ftA", be quit-
claimed to the current owners of the property.
