Following is the estimated total project cost, based upon the actual low bid price. Construction Contract Engineering & Inspection (W.O. #1301) Sub Total Contingencies (10%)t TOTAL ESTIMATED PROJECT COST $ 64,988.00 $ 5,000.00 $ 69,988.00 $ 7,012.00 $ 77,000.00 At the bid opening, the second bidder filed a verbal protest and later submitted a letter stating concerns over the adequacy of the low bidder's license. Staff has checked on this and determined that the low bidder is a qualified contractor for this work. Additionally, the low bidder has supplied references on this same type of work for other public and private agencies. Staff has contacted some of the references and found that they have been satisfied with their work and have had no problems. An amount of $10,400 was allocated from CDBG funds under Account No. 121-544-57647, for design services. Supplemental CDBG Funds in the amount of $132,000 were later allocated, under Account No. 121-544-57959, for total available funds of $142,400. The special provisions state that no on-site work shall be done prior to 9-15-89, in order to avoid conflicts with the swimming season. O' 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 6/15/89 .. ~ ~ .. ~ o o o 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO CONTINENTAL ENERGY SYSTEMS, INC. dba DEBIN & 3 ASSOCIATES, FOR FURNISHING AND INSTALLING FILTRATION EQUIPMENT AT NUNEZ PARK SWIMMING POOL. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. Continental Energy Systems, Inc" dba Debin & 7 Associates, is the lowest responsible bidder for furnishing and 8 installing filtration equipment at Nunez Park Swimming Pool, in 9 accordance with Plan No. 7750, for the total amount of 10 $64,988.00, and a contract is awarded to said bidder accordingly, 11 but such award shall be effective only upon the contract being 12 fully executed by the parties; all other bids therefore are 13 hereby rejected; and the Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifica- tions thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of the passage of this resolution.
