STAFF REPORT
Tentative Tract No. 11017 was approved by the Mayor and
Common Council on September 10, 1979. Also, extension of time
was approved by the Mayor and Common Council on March 9, 1981.
At the Council meeting of March 23, 1981, Resolution No.
81-137 was adopted. This resolution approved the Final Map for
Tract No. 11017, accepted public dedication as set forth on the
map, and authorized the execution of agreements.for the improve-
ments of the tract. Final Map was recorded on April 16, 1981,
in Book 157, Pages 37/38.
The reason for the proposed action is due to change of
ownership.
Tract No. 11017 is a IS-lot, Single Family Subdivision.
The required bonds and Certificates of Insurance have been filed
with this office, and the prescribed fees have been paid.
Therefore, we recommend that execution of a new agreement
and release of the existing agreement relating to the improvements
to be installed in Tract No. 11017, be authorized.

2 RESOLUTION NO.
3 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING
EXECUTION OF A NEW AGREEMENT AND RELEASE OF THE EXISTING
4 AGREEMENT RELATING TO THE IMPROVEMENTS TO BE INSTALLED IN TRACT
NO. 11017 LOCATED ON THE NORTHEAST CORNER OF LA PRAIX AVENUE AND
5 PACIFIC STREET APPROXIMATELY 140 FEET WEST OF SEINE AVENUE.
6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
7 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor and Common Council find that proposed
9 Subdivision Tract No. 11017, located on the Northeast corner of
10 La praix Avenue and Pacific Street approximately 140 feet West of
11 Seine Avenue, together with the provisions for its design and
12 improvements, is consistent with the General Plan of the City of
13 San Bernardino.

SECTION 2.
James F. and Goldie F. Stembridge are hereby
15 released from the standard form agreement executed on March 25,
16 1980.

SECTION 3.
The Mayor of the City of San Bernardino is
18 hereby authorized on behalf of said City to execute the standard
19 form of agreement adopted by Resolution No. 84-8 with Koinoia
20 Associates, a Limited partnership, for the improvements in
21 Subdivision Tract No. 11017, as required at Section 18.44.010 of
22 the San Bernardino Municipal Code.

SECTION 4.
Section 12(b) of said agreement is hereby
24 amended to require public liability insurance in an amount of not
25 less than $250,000.0 per person and $500,000.00 per occurrence.

The time for performance is specified at 24 months.

SECTION 5.
The Subdivider shall first execute the
5 agreement referenced in SECTION 3 hereof for the improvements
6
within said subdivision.
The City Clerk shall certify the
7 approval and acceptance of the Mayor and Common Council as set
8 forth in this resolution.
9 I HEREBY CERTIFY that the foregoing resolution was duly
10 adopted by the Mayor and Common Council of the City of San
