Lamberth, administrator of the Estate of Bessie R. Lamberth, do hereby formerly confirm my protest of the removal of the eight (8) trees noted in the attached copies of "City of San Bernardino Street Tree Removal Permit No. 1-88", and "I~otification of Tree Removal" form. My reasons for protesting this action are noted below: * An on site, and more importantly, a "from the air" inspection of the properties in question will, given proper altitude in flight approach, reveal little if any, "visual navigational hazard" for incoming aircraft to Norton Air Base. On the other hand, removal of subject trees will, if anything, increase the hazard to the properties and present/future occupants of the properties located immediately below the incoming flight pattern. * A careful examination of the area will reveal that removal of subject trees could increase the possibility of an aircraft hitting the power lines that are in close proximity of the trees, unless of course, there are plans to simultaneously relocate subject power lines underground. Also, night traffic on Tippecanoe could be at increased risk given the proximity of the navigational lights to Tippecanoe Avenue, if the point of removal of the trees is to reduce the approach (or angle of desent) to Norton Air Base. What other reason can there be for removing them? * At ground level, the trees currently serve as somewhat of a buffer to the considerable brightness emitted by the navigational lights due east of the properties in question (God knows, the existing noise factor is sufficient mental and physical agitation for one caught up in this situation. ) In reviewing the title policy to this property, I find no recorded easements or "Public right-of-way" footage noted on the eastern boundary of subject property where the trees currently stand. * * Finally, after reviewing the map covering this and the surrounding area, the CZ zones, decibel factors and zoning restrictions - the value of the property for which I have a fiduciary responsibility, has already been sufficiently deminished - given the fact that subject property is situated immediately under the incoming flight pattern and at considerably more risk than some other properties i.e., properties to the southeast of this property, purchased by the government to supposedly reduce the risk factor. \.,~ ;r, c. o o o City of San Bernardino Page 2 Therefore, I cannot in good conscience, approve a request that increases rather than decreases the risk factor. USAF Base Civil Engineer CITY OF SAN BERNARDINO STREET TREE REMOVAl PERMIT NO. 1-88 Permission is hereby granted for the removal of eight (8) Chinaberry trees from the City of San Bernardino public right-of-way located on the west side of Tippecanoe at the old Sullivan Street intersection, San Bernardino, California, to eliminate a visual navigation hazard. The removal shall be completed at the United States Air Force expense without compensation from the City. The United States Air Force will be responsible for damages occurring on the public right-of-way during the removal. ThiS permit will become effective when signed by the Director of Public Services, City of San Bernardlno, and will be valid for no more than three (3) months. The Director.bf Public Services shall be notified eighteen (l8) hours prior to start of work. Failure to comply with the conditions of this permit could result in being charged with an infraction of City of San Bernardino Municipal C1de 12.40 and fined accordingly. It is with the understanding the tree(s) will be removed. by City forces but not replanted. .
